Mining Lease. 5. (1) Notwithstanding the provisions of the Mining Act on application made to the Minister for Mines by the Joint Venturers, not later than 3 months after the commencement date, for a Mining Lease over so much of the mining areas as they desire and in respect of which the Joint Venturers or either of them then hold mining leases or other mining tenements the State shall upon the surrender of all mining leases and other mining tenements held by the Joint Venturers or either of them in respect of land within the mining areas cause to be granted to the Joint Venturers a Mining Lease of the land so applied for such Mining Lease to be granted under and, except as otherwise provided in this Agreement subject to the Mining Act but in the form of the Schedule hereto and subject to such of the conditions of the surrendered mining leases and mining tenements as the Minister for Mines determines and such other conditions as the Minister for Mines may impose pursuant to section 84 of the Mining Act.
Mining Lease. When the mining claims comprising the Property reach their tenth anniversary date, the Participants, as undivided co owners, shall cooperate and take all necessary steps to obtain a mining lease of the Property or relevant portion thereof determined by the Management Committee, which mining lease will be held by the Operator in trust for the Participants as their respective interests may, from time to time, appear.
Mining Lease refers to the Appendix of the Contract on prospecting, Contract on Construction and (or) exploitation of underground structures, not connected with prospecting and (or) production, Contract on Production of generally found mineral resources for commercial use, which shall be an integral part of the Contract or an independent document, in case of execution of the Servitude, which determines schematically and relatively the plot of subsoil, on which the Subsoil User shall have the right to carry out Prospecting, Construction of underground structures, not connected with Prospecting and (or) Production, or realization of the Servitude.
Mining Lease. 12.4.1 The Parties record that Mining Lease 12/1999 in respect of an area indicated on diagram SG No B24/68: RMT M137/68 (the “Mining Lease”), partially affects the Property. The Mining Lease is in favour of Driefontein and there is currently no rental payable on the Mining Lease.
Mining Lease. All diamond drill holes drilled during the JV were within a maximum distance of 1.3 kilometres from the Mining Lease and most drill holes are only a few hundred metres away from the Mining Lease boundary. Given that most of the immediate near-mine targets surrounding Laukunkangas have now been tested by drilling and with the JV Agreement's Stage 1 expenditure milestone of US$ 5 million approaching (whereby Rio Tinto would have earned a 51% stake in the Project) it was a logical time for both parties to make a decision on whether or not to continue the JV. "Bluejay's focus will now turn to assessing the wealth of as-yet-untested targets that have been identified along the Enonkoski Belt through the various regional geophysical surveys, top of bedrock drilling and geological mapping programmes under the JV. This includes the Makkola intrusion which is located close to the Hälvälä Ni-Cu-Co Mine in the eastern part of the >15 kilometre long belt. This target ranked very highly in the recent belt scale prospectivity assessment of all known intrusions. The recent work, including a detailed ground gravity survey, indicates the potential for the presence of shallow mineralisation at Makkola. "Alongside these activities, we will be assessing strategies for the project going forward for the best outcome for our shareholders. We have enjoyed an excellent collaborative partnership with Rio Tinto and thank them for their professionalism, technical input, and support throughout these last two years."
Mining Lease. If upon the expiration of this Agreement the Company has carried out its obligations under the Agreement to the satisfaction of the Government and has successfully established to the Government that the development of a mine from ore reserves established within the Licensed Area is economically and financially feasible, then the Company shall have the first option to (i) acquire a lease for the purposes of mining in the Licensed Area, and (ii) participate in a mining project in the Licensed Area subject to application for a mining lease in accordance with Act 703.
