SWITCH EQUIPMENT definition

SWITCH EQUIPMENT means any equipment and/or software, which is supplied by or on behalf of SWITCH, irrespective of ownership of the equipment, to the CLIENT or placed at or on the CLIENT’S premises for the purposes of providing the SERVICE.

  • All risk of loss or damage, howsoever arising, resulting from the SWITCH EQUIPMENT on CLIENT’S and/or SWITCH’S premises will remain vested with CLIENT for an amount no less than the full replacement value of the SWITCH EQUIPMENT.

  • CLIENT shall provide SWITCH and/or its appointed agent or sub contractors with such access as is reasonably required and any technical/personnel assistance reasonably necessary for the installation, maintenance and de-installation of the SWITCH EQUIPMENT including, without limitation, electricity supply and suitable accommodation and environmental conditions for the housing of the SWITCH EQUIPMENT.

  • Save as expressly set out in this agreement, SWITCH does not make any representations nor gives any warranties or guarantees of any nature whatsoever in respect of the SWITCH EQUIPMENT or the SERVICE and all warranties which are implied or residual at common law are hereby expressly excluded.

  • In the event that CLIENT refuses to release the SWITCH EQUIPMENT to SWITCH within 7 (seven) days of said termination, CLIENT shall become liable for an amount equal to the full replacement value of the SWITCH EQUIPMENT.

  • SWITCH shall not be liable for any damage or loss howsoever caused, resulting from a fault of any kind within SWITCH EQUIPMENT and/or any equipment belonging to CLIENT.

  • SWITCH will install and maintain SWITCH EQUIPMENT at CLIENT’S premises.

  • In particular, CLIENT shall not tamper with or attempt to change any aspect of the functioning of SWITCH EQUIPMENT in any manner whatsoever.

  • CLIENT will be liable to SWITCH for any loss or damage to SWITCH EQUIPMENT except in so far as any such loss or damage is attributable to the grossly negligent or wilful act or omission of SWITCH, its agents or subcontractors.

  • CLIENT will only use SWITCH EQUIPMENT in accordance with any instructions SWITCH provides to CLIENT from time to time.

  • SWITCH EQUIPMENT is and shall remain the property of SWITCH and/or its suppliers unless specifically purchased from SWITCH by the CLIENT and paid for in full.

Ownership of the Service Equipment does not pass to Customer. Service Equipment does not include Verizon Facilities.

  • Electrical equipment means underground equipment that contains dielectric fluid that is necessary for the operation of equipment such as transformers and buried electrical cable.

  • Fixed Equipment means any property affixed in any way to the Licensed Premises existing at the time Notice to Proceed is given, whose removal would damage the Licensed Premises.

  • Fixtures and Equipment means, with respect to any Person, all of the furniture, fixtures, furnishings, machinery and equipment owned or leased by such Person and located in, at or upon the Assets of such Person.

  • New equipment means equipment for which, by the cut-off date, neither of the following events has occurred:

  • Movable equipment means a hand-held or non-hand-held machine or device, powered or unpowered, that is used to do work and is moved within or between work sites.

  • Computer Equipment means Covered Property that is electronic computer or other data processing equipment, including peripherals used in conjunction with such equipment, and electronic media and records.

  • Operating Equipment means furniture, furnishings, special lighting fixtures, carpeting, draperies, decorations or other special finishing work, signs, appliances and trade fixtures and equipment that is furnished, installed or used by the Contractor in its operations on the Airport. It does not include Fixed Improvements, or repair or maintenance of Operating Equipment or Fixed Improvements or displays or decorations that are of a seasonal or temporary promotional nature.

  • Interconnection equipment means a group of components or an integrated system owned and operated by the interconnection customer that connects an electric generator with a local electric power system, as that term is defined in Section 3.1.6.2 of IEEE Standard 1547, or with the electric distribution system. Interconnection equipment is all interface equipment including switchgear, protective devices, inverters or other interface devices. Interconnection equipment may be installed as part of an integrated equipment package that includes a generator or other electric source.

  • Data Processing Equipment means any equipment, computer hardware, or computer software (and the lease or licensing agreements related thereto) other than Personal Computers, owned or leased by the Failed Bank at Bank Closing, which is, was, or could have been used by the Failed Bank in connection with data processing activities.

  • Rental Equipment means the equipment identified on the Service Agreement and Order Schedule or otherwise notified to you in writing that we will rent to you as part of our provision of the Services and which you will return to us after expiry or termination of the Agreement, subject to the provisions of this Agreement.

  • Accessory equipment means any equipment associated with the installation of a wireless telecommunications facility, including but not limited to cabling, generators, fans, air conditioning units, electrical panels, equipment shelters, equipment cabinets, equipment buildings, pedestals, meters, vaults, splice boxes, and surface location markers.
