In the event that the force majeure event lasts more than forty-five (45) days, NYSERDA may terminate this Agreement with no further obligation or liability to LSE other than to retire on behalf of LSE for Tier 2 REC compliance purposes any Tier 2 RECs for which LSE has made payment prior to termination.
