TIRZ Fund definition

TIRZ Fund means the City’s portion of the fund created by the City for the deposit of Tax Increment for the Zone, entitled “Reinvestment Zone Number Eleven, City of San Antonio, Texas.”
TIRZ Fund means the tax increment fund into which TIRZ Revenue is deposited. “TIRZ Revenue” means the total revenue collected and required by the TIRZ Act to be deposited into a tax increment fund each calendar year from participating taxing entities (excluding ad valorem tax revenues attributable to the mineral estate, including but not limited to oil and gas).

  • The Parties agree that the TIRZ Fund will reimburse Developer for Projects Costs in the order of priority of payment for the TIRZ.

  • In addition, if the audit determined that there were overcharges of more than 2% of the greater of the budget or payments to Developer for the year in which the discrepancy occurred, and the TIRZ Fund is entitled to a refund as a result of such overcharges, then Developer shall pay the cost of such audit.

  • Any contribution made by Developer in anticipation of reimbursement from the TIRZ Fund shall never be an obligation of the City’s General Fund, but are only obligations of the TIRZ Fund, and are subject to limitations herein.

  • The Administrative Costs shall be paid each year from the TIRZ Fund before any other Project Costs are paid.

  • If it is determined as a result of such audit that Developer has overcharged for the cost of the Public Improvements, then such overcharges shall be immediately returned to the TIRZ Fund and become due and payable with interest at the maximum legal rate under applicable law from the date the City paid such overcharges.

  • If it is determined as a result of such audit that Developer has overcharged for the cost of the Public Improvements and Public Infrastructure, then such overcharges shall be immediately returned to the TIRZ Fund and become due and payable with interest at the maximum legal rate under applicable law from the date the City paid such overcharges.

  • Developer may rely upon the payments to be made to Developer out of the TIRZ Fund as specified in this Agreement and Developer may assign its rights to such payments, either in full or in trust, for the purposes of financing its obligations related to this Agreement as per Section 16.5 hereof, but the Developer’s right to such payments is subject to the other limitations of this Agreement.

  • Each party to this Agreement understands and agrees that the City is the only participating taxing entity contributing 100% of the tax increment to the TIRZ Fund for this Project, and therefore, no other agreements are necessary with any other public entity to make this Agreement effective.


More Definitions of TIRZ Fund

TIRZ Fund means the fund set up by the City in order to receive the TIRZ Revenues in accordance with this Agreement, the TIRZ Act and the TIRZ Project and Finance Plan.
TIRZ Fund means any separate and distinct interest-bearing deposit account established by the City in order to receive deposits of the TIRZ Contribution.
TIRZ Fund means the tax increment fund created by the City and segregated from all other funds of the City.
TIRZ Fund means the fund created by the City for the deposit of Tax Increment for the TIRZ, entitled “Tax Increment Reinvestment Zone Number Thirty-One, City of San Antonio, Texas.” Singular and Plural: Words used in the singular, where the content so permits, also include the plural and vice versa, unless otherwise specified.
TIRZ Fund means the funds deposited by the City in the Tax Increment fund for the Zone. “Term” means the term of this Agreement as described in Article 2 of this Agreement.
TIRZ Fund means the fund required by the TIRZ Act into which the ad valorem taxes levied and collected by the City on the Captured Appraised Value is to be deposited.

  • Sub-Fund means a segregated pool of assets and liabilities into which the Trust Fund is divided, established under the Trust Deed and the relevant supplemental deed as a separate trust as described in the relevant Appendix.

  • Enterprise Fund means the enterprise fund of the Recipient in which Revenues are deposited.

  • Provident Fund means any fund (other than a pension fund, benefit fund or retirement annuity fund) which is approved by the Minister in respect of the year of assessment in question: Provided that the Minister may approve a fund subject to such limitations or conditions as he or she may determine, and shall not approve a fund in respect of any year of assessment unless he or she is in respect of that year of assessment satisfied -

  • Endowment fund means an institutional fund or part thereof that, under the terms of a gift instrument, is not wholly expendable by the institution on a current basis. The term does not include assets that an institution designates as an endowment fund for its own use.

  • Private Fund means an issuer that would be an investment company as defined in section 3 of the Investment Company Act of 1940 but for Section 3(c)(1) or 3(c)(7) of that Act.

  • Revenue Fund means the fund so designated in, and created pursuant to, Section 502 hereof.

  • State Fund The component of the Settlement Fund described in Section V.C.

  • Special Fund means any fund other than the city general fund.

  • Investment Fund has the same meaning as in National Instrument 81-106 Investment Fund Continuous Disclosure;

  • Venture capital fund means a private fund that meets the definition of a venture capital fund in SEC Rule 203(l)-1, 17 C.F.R. § 275.203(l)-1.

  • Fund means any Person (other than a natural person) that is (or will be) engaged in making, purchasing, holding or otherwise investing in commercial loans and similar extensions of credit in the ordinary course of its business.

  • Loan Fund means the special fund created by the RECIPIENT for the repayment of the principal of and interest on the loan. “Loan Security” means the mechanism by which the RECIPIENT pledges to repay the loan.

  • Feeder Fund means a Sub-Fund which invests all or substantially all of its assets in securities which are units or sub-units in a unit trust scheme or participations in a mutual fund or other interests in a collective investment scheme which is managed or advised by the Managers or any Associate of the Managers and whose investment policy is the same or substantially the same as such Sub-Fund.

  • Hedge Fund means an Alternative Investment Fund which employs diverse or complex trading strategies and invests and trades in securities having diverse risks or complex products including listed and unlisted derivatives;

  • Member Account means the regular account and the variable account.

  • Public fund means the state treasurer or a retirement system.

  • Expense Fund has the meaning set forth in Section 10.20(d).

  • Stock Fund means that portion of the Trust Fund consisting of Stock.

  • Feeder means a high voltage circuit served by automatic switchgear at 3.3kV and above, and for which the Distributor can reasonably aggregate network interruption statistics to monitor average feeder performance;

  • Master Fund means a registered investment company or a series thereof in which the Trust or a Series, as applicable, invests all or substantially all of its assets pursuant to a master/feeder fund structure as described in Section 8.3(c);

  • Pooled Fund means any pooled fund established and maintained by the Partners as a pooled fund in accordance with the Regulations Pooled Fund Manager means such officer of the Host Partner which includes a Section 113 Officer for the relevant Pooled Fund established under an Individual Scheme as is nominated by the Host Partner from time to time to manage the Pooled Fund in accordance with Clause 8.2. Provider means a provider of any Services commissioned under the arrangements set out in this Agreement.

  • Special Funds means, collectively, the Bond Fund, the Project Fund and the Collateral Fund, and any accounts therein, all as created in this Indenture.

  • Pre-Funding Account means the account designated as the Pre-Funding Account in, and which is established and maintained pursuant to Section 7.07.
