Examples of Total Settlement Value in a sentence
Pursuant to Federal Rule of Civil Procedure 23(h), Class Counsel may file a motion for an award of attorneys’ fees and litigation expenses relying upon and consisting of some portion of the Total Settlement Value.
The Releasing Parties considered such uncertainties in the course of negotiations leading to this Agreement, and the Releasing Parties have determined the Total Settlement Value to be fair and adequate compensation with due regard for such uncertainties.
Class Counsel may apply to the Court for a Fee Award, including reimbursement of costs and expenses, in an amount not to exceed $3.5 million or 35% of Total Settlement Value, whichever is higher (and inclusive of any and all fees and costs), to be paid from the Settlement Fund.
