Unauthorized Overrun Gas definition

Unauthorized Overrun Gas means any Gas taken on any Day by a Customer in excess of the curtailed quantity specified in any notice from FortisBC Energy to interrupt or curtail the Customer's take, and for greater certainty, Unauthorized Overrun Gas includes all Gas taken by a Customer to the extent that the obligation of FortisBC Energy to deliver such Gas is suspended by reason of Force Majeure.1.2 Change in Definition of "Day"‌FortisBC Energy may amend the definition of "Day" from time to time to suitably align its operations with those of its Transporters. If FortisBC Energy amends the definition of "Day", a pro-rata adjustment of quantities of Gas and charges to account for any Day of more or less than 24 hours will be made and the terms of the Service Agreement will be similarly adjusted.
Unauthorized Overrun Gas means Overrun Gas not accepted by Transporter for Nomination, pursuant to Section 6 hereof.
Unauthorized Overrun Gas means Overrun Gas not accepted by Horizon for scheduling pursuant to Section 7 hereof.

Examples of Unauthorized Overrun Gas in a sentence

  • Any gas taken by Buyer above the Maximum Daily Quantity, after notice from Seller of curtailment to the Maximum Daily Quantity, without Seller's advance approval, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 5, of the General Terms and Conditions to Industrial Service Agreements hereto attached.

  • Any gas taken by Buyer, including gas utilized as fuel for pilots, after any order of Seller calling for complete curtailment of Buyer's interruptible load, or any gas taken by Buyer in excess of a partial curtailment order, shall be Unauthorized Overrun Gas and shall subject Buyer to the penalty rate per dekatherm set forth in Article IV, Paragraph 6, of the General Terms and Conditions to Industrial Service Agreements hereto attached.

  • Any customer taking a material volume of Unauthorized Overrun Gas, during a period of ordered curtailment, may forfeit its curtailment credits for the respective winter season, December through March inclusive.

  • Any interruptible gas taken by Buyer after the effective hour of an order calling for complete curtailment of all interruptible gas deliveries hereunder shall be considered to be Unauthorized Overrun Gas.

  • The payment of Overrun penalty shall not, under any circumstances, be considered as giving the Buyer the right to take Unauthorized Overrun Gas, nor shall such payment be considered to exclude or limit any causes of action or other remedies available to Seller against the Buyer for failure to comply with curtailment orders issued by Seller hereunder.

  • Any remaining excess shall be classified as Unauthorized Overrun Gas.

  • The payment of an Overrun Penalty shall not, under any circumstances, be considered as giving Buyer the right to take Unauthorized Overrun Gas, nor shall such payment be considered to exclude or limit any other remedies available to Seller or another Buyer against the offending Buyer for failure to comply with its obligations to stay within its Maximum Daily Quantity.

  • Seller shall bill and Buyer shall pay, for such Unauthorized Overrun Gas at the rate of Twenty-five dollars and no cents ($25.00) per dekatherm, in addition to the Base Rate specified in the Service Agreement for such gas used.

  • Gas taken by a Buyer of "Firm Gas" on any day, without Seller's advance approval, which exceeds Buyer's Maximum Daily Quantity shall be considered to be Unauthorized Overrun Gas.

  • For Unauthorized Overrun Gas FortisBC Energy will bill on the basis of the schedule(s) setting out the Gas supply allocation for the Group provided to FortisBC Energy pursuant to Section 3.7 or if the Shipper Agent fails to provide a schedule pursuant to Section 3.7 then on the basis of the applicable Standard Priority Schedule provided by the Shipper Agent pursuant to Section 3.5 (Standard Gas Supply Priority Schedule (Standard Priority Schedule)).
