With respect to Canada, Licensor shall license to Licensee the following VOD Included Programs hereunder: (a) all Current Films with a VOD Availability Date during the VOD Avail Term and (b) at least three hundred (300) Library Films during each VOD Avail Year.
The VOD Availability Date for each VOD Included Program shall be as determined by Licensor in its sole discretion but not later than forty-five (45) days after the Home Video Rental Street Date.
Such lists shall include each program’s VOD Availability Date, VOD License Period and available resolutions (e.g. HD and/or SD).
Licensee acknowledges that the PPV Availability Date and the VOD Availability Date for any Current Film may occur on different dates, and that a Current Film with a VOD Availability Date that is day and date with its LVR may have a PPV Availability Date that is up to 14 days after the VOD Availability Date.
Subject to Section 8.9 of Schedule A, Licensor shall license and Licensee shall accept for licensing hereunder the following number of VOD Included Programs during each VOD Avail Year of the Avail Term: (a) all Current Features that Licensor makes generally available for non-exclusive VOD distribution in the applicable Territory that have a VOD Availability Date during such VOD Avail Year; and (b) at least one hundred (100) Library Features.
The VOD License Period for each VOD Included Program shall commence on its VOD Availability Date and shall expire on the date established by Licensor in its sole discretion; provided, that the License Period for each Current Feature shall end no earlier than the latest date during the Avail Term that such Current Feature is authorized to be made available on a VOD basis by any Other Distributor in the applicable Territory.
