ACCEPTANCE OF WORK PRODUCT. 9.1 Corcept agrees to review all work products submitted by Scirex and to advise Scirex promptly of any errors or omissions of which Corcept becomes aware in the course of its review or thereafter. Scirex shall promptly, at its expense, correct all errors or omissions that it discovers or which are brought to its attention by Corcept within ninety (90) days after submission of work product to Corcept, and will make corrections to all errors or omissions after ninety (90) days for additional compensation at cost. Cost shall be defined as Scirex' standard hourly rates reduced appropriately to eliminate Scirex' corporate SG&A and profit. Cost shall also include pass-through expenses.
ACCEPTANCE OF WORK PRODUCT. 4.1. Upon completion of the delivery of any Work Product in accordance with a Task Order the Client shall have thirty (30) calendar days after delivery to provide Anmut with a written objection if Client can reasonably demonstrate that the Work Product has not been completed in accordance with the specifications in the Task Order (“Objection”). Any Objection must include a detailed identification of each element of the Work Product within the Task Order that has not been properly completed. Objections as to matters not related to Work Products set out in the Task Order shall not constitute a proper basis for an Objection. Upon receipt of an Objection, Xxxxx’s sole obligation shall be to correct and re-deliver the Work Product in a manner that is consistent with the Task Order. Acceptance by Client of all Work Products delivered by Anmut shall be deemed to have occurred (a) if no Objection is delivered to Anmut within thirty (30) calendar days after delivery, (b) if any Work Products are used for commercial purposes by Client, or (c) when any valid deficiencies noted in an Objection have been remedied by Anmut in accordance with this Clause 4.1, in each case whichever is earlier.
ACCEPTANCE OF WORK PRODUCT. Buyer shall inspect all work completed by Xxxxx. Buyer shall be deemed to have irrevocably accepted the work as conforming to the contract if Xxxxx has not given to Renew a written notice of rejection, describing in detail the basis for rejection, within two (2) days after installation. In the event of rejection, Xxxxx shall have a reasonable amount of time to revise and resubmit the work to the Buyer, in which case the previous provisions shall again apply regarding acceptance by Buyer.
ACCEPTANCE OF WORK PRODUCT. For work product that is not part of the day-to-day delivery of IT Services hereunder, including specifically-requested Derivative Systems (as defined in Section 6.3(c)), following delivery of that work product by PODS to Westar, Westar shall, within thirty (30) days of delivery by PODS, review the delivered work product and approve it or notify PODS in writing of non-approval, documenting in reasonable detail any and all material defects in that delivered work product. PODS shall, within thirty (30) days of receipt of such notice, correct any such material failures and resubmit the work product to Westar.
ACCEPTANCE OF WORK PRODUCT. BDSI agrees to review all work products submitted by Premier Research and to advise Premier Research promptly of any errors or omissions of which BDSI becomes aware in the course of its review or thereafter. Premier Research shall, at its expense, correct all errors that it discovers or which are brought to its attention by BDSI within *** days after submission of work product to BDSI. Notwithstanding any other provision of this Agreement, Premier Research shall not be liable to BDSI, its affiliates, successors or assigns for errors in work product which are not known to Premier Research and are not brought to Premier Research’s attention within the above-stated notice period. Premier Research’s liability within the above-stated notice period shall ***. If errors or omissions are not known to Premier Research or brought to its attention within the above-stated notice period, the work product to which they relate shall be deemed accepted and approved by BDSI.
ACCEPTANCE OF WORK PRODUCT. Within ten (10) working days after receipt of Consultant's completed report ("Work Product"), Company will accept or reject the Work Product. In the event Company rejects the Work Product, Company may at its option require Consultant, at Consultant's own expense, to revise the Work Product to render it acceptable to Company. Consultant will have ten (10) working days to submit the revised Work Product to Company. ACCEPTANCE OF WORK PRODUCT. Upon completion of any Work Product deliverable to Wave, the parties shall collaborate in promptly testing such Work Product. Any Work Product delivered by Archon shall be deemed to have been accepted by Wave only upon Wave's written notice to Archon of its acceptance of such Work Product. Any such acceptance of any Work Product shall not be deemed to be a waiver of any warranties (express or implied) in favor of Wave.
ACCEPTANCE OF WORK PRODUCT. 7.1 NTI agrees to review all work products submitted by SCIREX and to advise SCIREX promptly of any errors or omissions of which NTI becomes aware in the course of its review or thereafter. SCIREX shall, at its expense, correct all errors that it discovers or which are brought to its attention by NTI within ninety (90) days after submission of work product to NTI, and will make corrections to all errors or omissions after ninety (90) days for additional compensation at cost. Cost shall be defined as SCIREX’s standard hourly rates reduced appropriately to eliminate SCIREX’s corporate selling, general and administrative expenses and profit. Cost shall also include pass-through expenses.
ACCEPTANCE OF WORK PRODUCT. Avanir agrees to review all work products submitted by SCIREX and to advise SCIREX promptly of any errors or omissions of which Avanir becomes aware in the course of its review or thereafter. SCIREX shall, at its expense, correct all errors that it discovers or which are brought to its attention by Avanir within ninety (90) days after submission of work product to Avanir. Notwithstanding any other provision of this Agreement, SCIREX shall not be liable to Avanir, its affiliates, successors or assigns for errors in work product which are not known to SCIREX and are not brought to SCIREX attention within the above-stated notice period. SCIREX' liability within the above-stated notice period shall be limited to correction of the errors brought to its attention and shall not include consequential or special damages, including, without limitation, loss of profits. If errors or omissions are not known to SCIREX or brought to its attention within the above-stated notice period, the work product to which they relate shall be deemed accepted and approved by Avanir.
