Access Prior to Substantial Completion. Subject to this Section 1.3, beginning on or about February 1, 2006 (or such later date as may be required in the event of Tenant Delays or other Force Majeure), Tenant will be allowed to install its racking and related trade fixtures in the warehouse portion of the Premises; provided, however, that (a) any such use of the Premises is also subject to, and Tenant must comply with and observe, all applicable Laws (including, without limitation, any required Certificate of Occupancy), all safety rules and procedures of applicable governmental authorities and all reasonable safety rules and procedures of Landlord, and all other terms and conditions of this Lease, (b) Tenant will not unreasonably interfere with the construction of Tenant's Improvements or cause any labor dispute as a result of Tenant's installations, (c) Tenant assumes all risk of loss or damage to Tenant's racking and related trade fixtures and to any and all personal property of Tenant or its contractors, subcontractors, agents and employees, unless caused by the gross negligence or willful misconduct of Landlord, and (d) Tenant will indemnify, defend, save and hold harmless the Landlord Parties from and against any loss or damage to such racking, trade fixtures and other personal property, and all liability, loss or damage arising from any injury to the property of Landlord, or its contractors, subcontractors or materialmen, and any death or personal injury to any person or persons to the extent arising out of such installations, unless caused by the gross negligence or willful misconduct of Landlord. Landlord may, at any time, suspend Tenant's rights to the aforesaid access prior to the Commencement Date if Landlord reasonably determines that such access or any work being performed by or for Tenant is unreasonably interfering with the construction of Tenant's Improvements, is creating security or safety risks or is otherwise not in conformance with the conditions of this Section 1.3. Beginning on the date on which Tenant commences any activities in the Premises pursuant to this Section 1.3, and continuing through the day before the Commencement Date, Tenant will contribute to the payment of the utility charges at the Premises, if such charges are higher than would customarily be the case for contractors performing the construction of Tenant's Improvements, or otherwise would have been the case, in the absence of such work by or for Tenant. Access Prior to Substantial Completion. If Tenant so requests, Landlord will allow Tenant limited access to the Premises prior to Substantial Completion thereof to begin installing equipment, fixtures, and cabling and/or to properly coordinate such work with the construction of the Leasehold Improvements. Any such access will be subject to Landlord's prior consent in each instance, which consent will not be unreasonably withheld but may be conditioned on Tenant's work not interfering with the construction of the Leasehold Improvements. Any such use of the Premises is also subject to, and Tenant must comply with and observe, all applicable Laws and all other terms and conditions of this Lease, except that Tenant will not be obligated to pay Basic Rent or Additional Rent for Property Expenses until the Commencement Date. In no event may Tenant conduct business in the Premises during such early access period.
Access Prior to Substantial Completion. Landlord will allow Tenant limited access to the Premises approximately sixty (60) days prior to Substantial Completion to begin installing equipment, fixtures, furniture and cabling and/or to properly coordinate such work with the construction of the Tenant Improvements. Any such access will be conditioned on Tenant’s work not interfering with the construction of the Tenant Improvements. Any such use of the Premises is also subject to, and Tenant must comply with and observe, all applicable Laws, all safety rules and procedures, and all other terms and conditions of this Lease, excluding, however, the payment of Rent until the Commencement Date. In no event may Tenant conduct business in the Premises during such early access period.
Access Prior to Substantial Completion. Landlord will allow Tenant limited access to the Premises prior to Substantial Completion on June 23, 2008, for partial occupancy if all governmental requirements for occupancy have been met and to begin installing equipment, fixtures, and cabling and/or to properly coordinate such work with the construction of the Tenant Improvements. Landlord has no obligation to provide a certificate of occupancy until Substantial Completion. Any such access will be subject to Xxxxxxxx’s prior consent in each instance, which consent will not be unreasonably withheld but may be conditioned on Tenant’s work not interfering with the construction of Tenant Improvements or causing a labor dispute. Any such use of the Premises is also subject to, and Tenant must comply with and observe, all applicable Laws and all other terms and conditions of this Lease provided that Tenant shall not be required to pay Rent during such period. In no event may Tenant conduct business in the Premises during such early access period unless an occupancy permit has been received allowing same. All Tenant’s alterations shall be subject to the provisions of Article 8 hereof.

  • Upon Substantial Completion of the Work or designated portion thereof and upon application by the Contractor and certification by the Architect, the State shall make payment, reflecting adjustment in retainage, if any, for such Work or portion thereof, as provided in the Contract Documents.

  • COMMENCEMENT AND COMPLETION OF THE PROJECT Section 3.01 The Project (a) The Company intends and expects, together with any Sponsor Affiliate, to (i) construct and acquire the Project, and (ii) meet the Contract Minimum Investment Requirement within the Investment Period. The Company anticipates that the first Phase of the Project will be placed in service during the calendar year ending December 31, 2020. Anything contained in this Fee Agreement to the contrary notwithstanding, the Company and any Sponsor Affiliates shall not be obligated to complete the acquisition of the Project. However, if the Company, together with any Sponsor Affiliates, does not meet the Contract Minimum Investment Requirement within the Investment Period, the provisions of Section 4.03 hereof shall control. (c) The Company may add to the Land such real property, located in the same taxing District in the County as the original Land, as the Company, in its discretion, deems useful or desirable. In such event, the Company, at its expense, shall deliver an appropriately revised Exhibit A to this Fee Agreement, in form reasonably acceptable to the County.

  • Effect of Completion This agreement shall, as to any of its provisions remaining to be performed or capable of having or taking effect following Completion, remain in full force and effect notwithstanding Completion.

  • Commencement and Completion The Work shall commence on _______________, 20__ and shall be complete in accordance with this Agreement without delay on ______________, 20__. The term “day”, used throughout this Agreement, refers to calendar days. Contractor shall not be entitled to any additional compensation for any Permitted Delays.
