Common use of Access to Employees Clause in Contracts

Access to Employees. MSEA-SEIU shall have access to employees covered by this Agreement to carry out its legal responsibilities as a bargaining agent as provided for in this Article. MSEA-SEIU's representatives will be granted reasonable access to employees during employees' working hours for the purpose of investigating and processing grievances and for the purposes of administering this Agreement. Such access will be subject to the representative providing the appropriate State representative with advanced notice of the visit. Such access will not disrupt State operations or violate agency security procedures. If access needs to be temporarily delayed for special reasons, those reasons shall be explained to the MSEA-SEIU representative. Any MSEA-SEIU representative may have access to employees in this unit for the purpose of explaining MSEA-SEIU programs and benefits during employees' non-working time, e.g., breaks, lunch periods and after hours, provided such access does not interfere with State operations. Each new employee, including employees who are new to an MSEA-SEIU bargaining unit, shall be allowed one (1) hour of paid work time within their first six (6) months of employment to meet with a representative of MSEA-SEIU for the purpose of explaining MSEA-SEIU programs and benefits. This meeting shall be scheduled at a time approved by the employee’s supervisor and shall take place in a non- work area.

Any MSEA-SEIU representative may have access to employees in this unit for the purpose of explaining MSEA-SEIU programs and benefits during employees' non-working nonworking time, e.g., including breaks, lunch periods hours and after the employee’s work hours, provided such access does not interfere with State operations. Such access shall be to and in non-work areas. The agencies of Access shall not disrupt legislative operations or violate any security procedures but will not be unreasonably denied. If the State shall inform MSEA-SEIU of their new employee orientations and/or new hire paperwork processes and shall invite MSEA-SEIU Executive Director or the Executive Director’s designee denies access to participate in orientation or new hire meetings through a brief presentation on MSEA-SEIU either in person or electronicallythe MSEA representative for the time requested, the reason for denial will be explained to the MSEA representative. Each new employee, including employees who are new to an MSEA-SEIU the MSEA bargaining unit, shall be allowed one (1) hour up to 60 minutes of paid work time within their his or her first six (6) months of employment to review materials provided by MSEA and to meet with a representative of MSEA-SEIU MSEA for the purpose of explaining MSEA-SEIU MSEA programs and benefits. This meeting shall be scheduled at a time approved by the employee’s supervisor and shall take place in a non- non-work area. During a new employee’s orientation, the employer shall make available a link to an informational video produced by MSEA.

Each new employee who does not attend an in-person orientation or new hire meetings through a brief presentation on MSEA-SEIU either in person or electronically. Each new employee, including employees who are new to an MSEA-SEIU bargaining unit, meeting shall be allowed one (1) hour of paid work time within their first six (6) months of employment to meet with a representative of MSEA-SEIU for the purpose of explaining MSEA-SEIU programs and benefits. This meeting shall be scheduled at a time approved by the employee’s supervisor and shall take place in a non- work areaSEIU.
