Additional Compensation Terms. Effective April 12, 2022, on the first business day of each week and prior to issuing weekly work orders pursuant to the CONTRACT, the staff of the CITY’S Park and Recreation Department shall confirm the current price of gasoline in the City of Wichita. The price of gasoline will be confirmed according to the “AAA Gas Prices” website available at xxxxx://xxxxxxxxx.xxx.xxx/?state=KS. If information for the current price of gasoline in the City of Wichita is not available when the CITY’S Park and Recreation Department attempts to confirm the price on that website, the current price of gasoline in the state of Kansas according to the same website shall be used instead. If the current price of gasoline is confirmed by the CITY’S Park and Recreation Department to exceed $3.40 per gallon, a three percent (3%) fuel surcharge shall be added to the assigned work order for VENDOR. • Sections 5 through 8 of the CONTRACT concerning “Independent Contractor,” “No Assignment,” “Non-Discrimination,” and “Third-Party Exclusion,” as well as an Exhibits incorporated therein, are hereby deleted, with the following language and incorporated Exhibits to be included in the CONTRACT instead:
