Air Space Usage. The Contractor agrees that the efficient use of the available capacity (air space) of the landfill is of extreme importance to the Department and agrees to perform all operations in such a way as to maximize the amount of waste disposed within the available air space. The Department shall survey (ground survey or GPS) the landfill area at the beginning and end of the measurement period. The initial ground survey shall be adjusted to deduct the existing cover soil. The average cover soil depth shall be based on the field measurements as potholed by the Contractor and observed by the Department. The pothole grid shall be agreed upon by both Department and Contractor prior to commencing work. Potholes shall be done at a minimum frequency of four holes per acre, including sloped areas. The final ground survey shall subtract the one-foot thick cover soil as specified in the Contract Plans. No modifications to the volume calculation shall be made should the Contractor place more than one-foot of cover soil. Contractor has the option to participate in the survey, in consultation with the Department, through the use of a qualified survey firm retained by the Contractor. Contractor may request for more intense ground survey for the initial and final survey grid. Contractor shall compensate the Department for a portion of this additional ground survey as determined by the actual cost of the additional survey work. Department shall deduct this portion of the extra survey cost from the monthly payment (See Section 5.1.1). The weight on which the Contractor is paid is based on the per ton fee as defined in Section 5.1.1, shall be used as the weight portion of the air space density. The Department's determination of the air space density measurement shall be final and binding on all parties. The initial air space density measurement period shall commence within seven days following commencement of the Agreement. The Department with input from the Contractor shall determine the duration of each measurement period. The duration will be based on planned fill sequencing, survey crew availability, and other factors determined by the Department. The measurement period (MP) typically will range from 180 to 365 days. An air space density (D) shall be calculated using the volume measurement in cubic yards and waste weight in tons from the same measurement period.   • Storage Space Effective as of the Second Floor Commencement Date, Landlord hereby leases to Tenant certain additional space containing approximately 1,000 rentable square feet in such areas as more particularly designated on Schedule X- 0 xxxxxxxx hereto. In addition, Landlord hereby grants to Tenant the right to lease certain additional storage space in such areas of the Project as are designated for storage by Landlord on a first-come, first-served basis (the initial storage space and additional storage space leased to Tenant by Landlord, if any, are collectively the "Storage Space"). Tenant may exercise its option to lease additional Storage Space from time to time throughout the term of the Lease by giving written notice to Landlord of its desire to lease the same, which notice shall be conditioned upon the availability of the desired space. Tenant shall pay Landlord an annual rental for the Storage Space (the "Storage Rent") equal to $10.25 per rentable square foot of GLA of the Storage Space, adjusted annually at the rate of 2 1/2% per annum. The Lease Years for Storage Space shall be concurrent with the Lease Years for the Premises. No janitorial or trash removal services shall be provided to the Storage Space. No other charges shall be applied, as Additional Rent or otherwise, to the Storage Space, except for charges incurred by Landlord in enforcing its rights relating to the Storage Space under this Lease, in accordance with the terms of this Lease. The Tenant shall have the option, exercisable at any time during the Term, to cancel its lease of the Storage Space, upon thirty (30) days' prior written notice to the Landlord. Except as provided in this Section 2.1(b), the terms and conditions of Tenant's occupancy of the Storage Space shall be as set forth in this Lease. The Storage Space shall be leased in its absolute "AS IS" condition. There shall also be no core factor for the Storage Space (i.e., the usable areas shall be equal to the rentable area).

  • Open Space Acquisitions within the PPA. The County agrees that for the term of this IGA it will not purchase or otherwise acquire any land within the PPA for open space purposes, including conservation easements and transfer of development right sending sites without the approval of the Town.

  • Guests; Occupancy Limits No more than one person may occupy a bedroom space, except for minor children for whom the Resident is the parent or legal guardian with Owner’s consent and with consent of apartment-mates as applicable . If Resident desires to have an Overnight Guest (any person staying in the Resident’s assigned bedroom space or apartment for more than three total nights in any 30-day period), then Resident must register the Overnight Guest(s) with Owner. Resident may not have Overnight Guest(s) for more than three consecutive nights, nor for more than six total nights in any 30-day period. In the event any unregistered or unauthorized Overnight Guest(s) are identified to be in or using an apartment or bedroom space, Owner may assess against the Resident a fee of $60 per night, in addition to the right of Owner to declare Resident in material breach of this Agreement and pursue other available remedies. Although Resident may have Guests from time to time, Owner reserves the right to restrict the number of persons permitted in or about an apartment at any time in Owner’s discretion, to protect safety and the quiet enjoyment of other residents. Guests may park only in designated guest parking areas, if any, and no Guest’s vehicle may remain at the Property for more than three days.

  • Equipment Usage The equipment must remain in use for the specific project for which it was obtained in accordance with 2 CFR § 200.313(c)(1), unless the provision in 2 CFR § 200.313(c)(4) applies.

  • Maximum Occupancy No more than two (2) guests per one (1) resident (who is present) are permitted in a student room/suite/apartment at any given time unless otherwise approved by the University (Residential Life).

  • Leaving School premises The School will do all that is reasonable to ensure that the Student remains in the care of the School during School hours, but note that the School cannot legally prevent a Student aged 16 years or over from leaving the School premises during School hours. Save for death or personal injury caused by its negligence or breach of other statutory duty, the School cannot accept any responsibility for the welfare of the Student whilst off the School premises unless they are taking part in a School activity or are otherwise under the supervision of a member of School staff.
