Airspace. A public right of flight through the airspace above the surface of the Premises. This public right of flight shall include the right to cause or allow in said airspace, any noise inherent in the operation of any aircraft used for navigation or flight through said airspace or landing at, taking off from, or operation on the Airport. No liability on the part of LANDLORD or any tenant will result from the exercise of this right.
Airspace. 1. The FAB CE airspace is subject to governance by the Contracting States as determined hereunder.
2. This Agreement does not affect the right of each Contracting State to apply the flexible use of airspace concept when reserving, restricting or otherwise organizing defined volumes of airspace not extending across its applicable airspace, for exclusive or specific use of military users and/or aircrafts operated as operational air traffic. Nevertheless, these airspace restrictions and reservations, having significant impact on civil traffic flows, shall be coordinated through JC MACC in line with the coordination process to be defined by the JC- MACC.
Airspace. From day D, the use of airspace will be as follows: Over the TLZNs and Security Zones military flights will be restricted to an altitude of 5,000 feet. In the event of any accident, public catastrophe or medical emergency, civilian aircraft may fly in these areas subject to MVM coordination with the National Government and the FARC-EP.
Airspace. The Host City shall ensure that the airspace in the Host City in the area above and around the Stadium and the FIFA Fan Fest, other than which is approved in writing by FIFA, shall, on Match Days, be free and clear of all commercial signage and/or advertising. In particular, the Host City shall co-operate with the civil aviation authority to ensure the implementation of this obligation and appropriate regulations and/or ordinances prohibiting any commercial signage and/or advertising on Match Days in such area.
Airspace. There is hereby reserved to LESSOR, its successors and assigns, for the use and benefit of the public, a right of flight for the passage of aircraft in the airspace above the surface of the Premises. This public right of flight will include the right to cause or allow in said airspace, any noise inherent in the operation of any aircraft used for navigation or flight through the said airspace or landing at, taking off from or operation on the Airport. No liability on the part of LESSOR will result from the exercise of this right.
Airspace. The City reserves the right to take such action it considers necessary to protect the aerial approaches to the Airport against obstruction, together with the right to prevent Lessee from erecting or permitting to be erected any building or other structure in the Airport which, in the opinion of the Airport, would limit the usefulness of the Airport or constitute a hazard to aircraft. Except to the extent required for the performance of any obligations of the Lessee hereunder, nothing in this Agreement shall grant to Lessee any rights whatsoever in the airspace above the Leased Premises other than those rights which are subject to Federal Aviation Administration (or other successor agency) rules, regulations and orders currently or subsequently effective.
Airspace. The inclusion and negotiation of a substantive issue in section 6.1 does not commit any of the Parties to conclude an agreement on that issue or any component of that issue.
Airspace. There is hereby reserved to County, its successors and assigns, for the use and benefit of the public, a right of flight for the passage of Aircraft in the airspace above the surface of the Premises herein leased. This public right of flight will include the right to cause or allow in said airspace, any noise inherent in the operation of any Aircraft used for navigation or flight through the said airspace or landing at, taking off from or operation on the Airport. No liability on the part of County will result from the exercise of this right.
Airspace. The City hereby reserves for the use and benefit of the public, the right of aircraft to fly in the airspace overlying the land herein leased, together with the right of said aircraft to cause such noise as may be inherent in the operation of aircraft landing at, taking off from, or in the vicinity of the Airport, and the right to pursue the operations of same. The City reserves the right to take any action it considers necessary to protect the aerial approaches of the Airport against obstructions, together with the right to prevent Concessionaire from erecting, or permitting to be erected, any building or other structure on any Leased Premises, which, in the opinion of the City, would limit the usefulness of the Airport, or constitute a hazard to aircraft.
