This updated resolution deleted provisions that were no longer relevant and adjusted the drafting of others for the sake of completeness and clarity, but did not affect the substantive rules and procedures concerning vessel assessments, in particular regarding the amount of the contributions to be made. At their 38th meeting in 2018, the Parties adopted Resolutions A-18-02 and A-18-03, both on observer safety at sea. AMENDMENTS AND RESOLUTIONS AFFECTING THE OPERATION OF THE IDCP. The 11th Meeting of the Parties passed two resolutions that affect the operation of the IDCP. Resolution A-04-02 requires any fishing captain on an IDCP vessel who has committed two or more night set infractions to attend an instructional seminar, as described in Section 3.1 of the Procedures for maintaining the AIDCP List of Qualified Captains, prior to his next trip as a fishing captain, unless no seminar is available before that trip, in which case he shall be required to attend a seminar as soon as possible thereafter. Resolution A-04-03 requires each Party to inspect its DML vessels twice a year to ensure that the dolphin safety gear and equipment requirements in Section 2 of Annex VIII of the AIDCP have been met. The 11th Meeting of the Parties also amended the Procedures for AIDCP Dolphin Safe Tuna Certification by adding a new Section 3, Procedures for invalid dolphin safe certificates. The 12th Meeting of the Parties passed Resolution A-04-07, which establishes a list of vessels presumed to have carried out illegal, unreported and unregulated (IUU) fishing activities in the Agreement Area. Once the Parties adopt the list , they shall ask non-parties with vessels on the list to take all the necessary measures to eliminate IUU fishing activities. The 12th Meeting of the Parties also amended Annex VIII (I) of the AIDCP to require that vessels with a DML have onboard an operable long-range, high-intensity floodlight with a sodium lamp of at least 1,000 xxxxx or a multivapor lamp of at least 1,500 xxxxx.

AMENDMENTS AND RESOLUTIONS AFFECTING THE OPERATION OF THE IDCP. During 2006, the AIDCP Parties adopted Resolution A-06-01 on vessel assessments and financing, which establishes the basis for the assessments paid by purse-seine vessels that fish in the EPO. These assessments are the principal source of funding for the operation of the AIDCP. Also with respect to financing, the Parties agreed that all charges for inactive vessels and fees for late payment will be retained by the Secretariat. (Previously, a portion of all fees received had been paid to the appropriate national programs.) In addition, it was decided that vessels entering the fishery during the course of a year that did not fish in the Agreement Area during the previous year are not required to pay the surcharge for late payment, regardless of their date of entry into the fishery. During 2006 the Parties also agreed to amend Annex IV.I.8 of the AIDCP to broaden the definition of the uses of DMLs from the Reserve DML Allocation (RDA) to reflect the principal rationale for the use of the RDA in practice, namely, assigning DMLs to vessels that legitimately enter the fishery during the course of the year, but too late to be assigned a DML in acccordance with the usual procedures.

  • Conditions Affecting the Work The Contractor shall be responsible for having taken steps reasonably necessary to ascertain the nature and location of the Work, and the general and local conditions, which can affect the Work or the cost thereof for any Job Order.   • Changes Affecting the Agreement The Employer agrees that any reports or recommendations made to Council dealing with matters covered by this Agreement including recommendations for changes in method of operation that may affect wage rates, work loads or reduction of employment will be communicated to the Union at such interval before they are dealt with by Council as to afford the Union reasonable opportunity to consider them and make representations to Council concerning them and further that if employees are deprived of employment by any implementation of such change, they shall receive priority consideration for other employment with the Employer.
