Appointment of Supplier. 2.1 With effect from the Commencement Date, the Company appoints the Supplier to provide the Supplies (and any related and ancillary services) in accordance with the timetable set out in the Authorizing Document.
2.2 The terms and conditions of this Agreement apply to all purchases of Supplies by the Company or its Affiliates to the exclusion of any terms and conditions submitted in any way by or on behalf of the Supplier or the Company.
Appointment of Supplier. (a) The Supplier is appointed to supply the Goods for sale by the Supplier at its Retail Premises during the Term, on and subject to the terms of this Agreement.
(b) If:
(i) the School Council has provided the Supplier with written notice that, in the reasonable opinion of the School Council, the Supplier cannot meet the reasonable stock levels required in clause 3.9(a) or the specific stock levels detailed in the School Council's notice under this clause; and
(ii) the Supplier is unable to supply the stock in the notice referred to in clause 3.1(b)(i) above within 30 days, the School Council may terminate this Agreement on notice to the Supplier.
Appointment of Supplier. 2.1 During the term of this Agreement, XXXX shall regard TULIP as its preferred supplier for the Products and will purchase its requirements for the Products directly from TULIP.
2.2 TULIP will use best diligent efforts to search for methods and means that will lead to improvements, including cost reductions while maintaining the same or improved quality of the Products. XXXX will cooperate with TULIP in these efforts. XXXX shall comply with all applicable laws and regulations relating to the sale of the Products.
Appointment of Supplier. 1.1 POLYMET is a supplier of Silicon Metal (hereinafter called the “Product”) which HOKU uses for its Polysilicon manufacture. Polymet shall obtain Product only from RIMA Industrial S/A, unless HOKU approves another source.
1.2 HOKU hereby appoints POLYMET to supply certain quantity of HOKU’s requirement of the Product subject to the terms and conditions set out in this AGREEMENT.
Appointment of Supplier. The Supplier agrees to supply the Services to AgriFutures Australia on a non-exclusive basis in accordance with the Services and in accordance with this Agreement. The Supplier accepts the appointment.

Appointment of Supplier. 2.1 The Company appoints the Supplier to provide Goods and/or Services, and the Supplier accepts the appointment, on and subject to these Terms and Conditions. The Supplier acknowledges that it is not the exclusive supplier of goods and services of the same or a similar nature as the Goods and Services and that the Company may use other suppliers and providers to provide such goods and/or services.
Appointment of Supplier. Subject to the terms and conditions hereof, Buyer hereby appoints Supplier as its exclusive source and supplier of all of the requirements of Buyer, its Affiliates and Partners for the products identified on Exhibit 1.1 hereto in the United States in packaged, ready-for-sale form (the “Products”), and Supplier agrees to act as the exclusive source and supplier of the requirements of Buyer, its Affiliates and Partners for the Products. For purposes hereof “Partner” means any Third Party to whom Buyer or its Affiliates has sold, assigned, transferred, disposed of, licensed or conveyed any of the Purchased Assets or rights in any Products. Notwithstanding anything to the contrary, upon written notice from Buyer, provided to Supplier in accordance with Section 19 at least thirty (30) days prior to the date of any requested change, Buyer may designate any of Buyer’s Affiliates or Partners for the purpose of furnishing purchase orders and for receipt of shipments of Products from Supplier; provided that, at any time, there shall be only one such party and that any such designation shall not relieve Supplier of its obligations hereunder.
Appointment of Supplier. The Catapult appoints the Supplier to, and the Supplier agrees to, perform the Services and deliver the Deliverables to the Catapult on and subject to the provisions of this Agreement.
Appointment of Supplier. Biomet hereby appoints Supplier, and Supplier hereby accepts such appointment, as manufacturer and supplier of the Products according to the Specifications listed in Schedule 1 hereto, subject to the terms and conditions of this Agreement.
