Appointment of the Operator. Subject to and in accordance with the provisions of this Agreement, the Authority hereby appoints, on a non-exclusive and non-transferable basis, the Operator, and the Operator hereby accepts its appointment to Refurbish, Operate and Maintain 110 existing Buses within the Bus Service Area in accordance with the terms of this Agreement and subject to the Applicable Laws and Applicable Clearances.
Appointment of the Operator. Subject to and in accordance with the provisions of this Agreement, the Authority hereby appoints, on a non-exclusive and non-transferable basis, and the Operator hereby accepts its appointment to maintain 11 Sidhi Lawn and organise events there in accordance with the terms of this Agreement and subject to the applicable laws and clearances.
Appointment of the Operator. The Airports Company hereby appoints the Operator to provide the Services in return for payment of the Service Fees in accordance with the terms and conditions of this Agreement. The Operator hereby accepts such appointment. The Operator acknowledges that the Airports Company will be under no obligation to provide the Operator with a continuous flow of work or revenue. The Operator acknowledges that the Airports Company's requirements for the Services and, accordingly, the provision of the Services to the Airports Company by the Operator in terms of this Agreement, shall be determined, inter alia, by the Airports Company's business needs, market forces and the dictates of the economic environment in which the Airports Company conducts its business. It is recorded that this Agreement is entered into on a principal-to-principal basis. Nothing in this Agreement, whether express or implied, shall be construed as creating any relationship either of landlord/tenant, employee/employer, principal/agent, partnership, associate or any other relationship of a like nature, between the Airports Company and the Operator or any of the Operator's employees, directors, officers or agents. Furthermore, the Operator shall not, under any circumstances: conclude any agreement in the name of the Airports Company or that would bind the Airports Company unless previously authorised to do so in writing; pledge the credit of the Airports Company or bind the Airports Company or act for and on behalf of the Airports Company in any way whatsoever; nor hold itself out as being employed by or in partnership with or associated with the Airports Company in any way other than as an independent contractor in terms of this Agreement. The Parties record that due to the nature of the Services, there are certain aspects of the Services where the Airports Company requires that it maintains a degree of control and/or supervision over the Operator's activities.
Appointment of the Operator. 1) The Contractor agrees to grant to the Operator the administration, operation and handling of all aspects of the administration of Internet Lottery games or by wireless networks, in the territory of the Republic of Guatemala.
2) The term of this Contract is seven years, renewable automatically for a second seven-year term, which begins at the official start of sales. The Contractor is obliged to prohibit the licensing to any other company, firm, seller or person to direct, operate, or commercialize any part or parts of the activities of lottery games through the Internet or wireless networks, in his territory. Likewise the Operator may not offer services to another person in the Republic of Guatemala for similar projects. The conditions for the extension or renovation of this Contract will be determined by mutual accord between the parts at an opportune moment. 3) The Operator: a) will be the exclusive operator and provider of the activities that are a result of the Lottery by Internet or wireless access, including without limitation, equipment, programming, support Systems, design and marketing; back-up Systems, all on his own account; b) responsible for the contracting, payment and training of the necessary personnel for the activities, as well as the acquisition by his own account and risk of Systems, goods and means necessary for the development of operations and including Internet Systems and other wireless networks and will provide working capital inherent to the business; c) provide Systems for validation, distribution, payment Systems and accounting; d) registration of patents, brands, propaganda symbols, and required programming for the handling of games, whose licenses will be active until the end of the term of the agreement; e) provide statements of accounts and other necessary monthly reports and a yearly statement audited by an accredited firm of certified public accountants. At any time the Contractor may verify accounts related to sales.

Appointment of the Operator. Subject to and in accordance with the provisions of this Agreement, the Authority hereby appoints, on a non-exclusive and non-transferable basis, the Operator, and the Operator hereby accepts its appointment to Procure/Supply, Operate and Maintain 125 Nos of 12m BRT AC Electric Buses and Procure, Operate and Maintain Transformers and Chargers and Establish & Maintain associated Electrical and Civil Infrastructure. The Electric Buses shall be as per Technical Specifications given in Volume 3 of the RFP andthe Operator shall maintain Daily Assured Fleet Availability, within the Bus Service Area in accordance with the terms of this Agreement and subject to the Applicable Laws and Applicable Clearances.
Appointment of the Operator. 3.1 The Owner appoints the Operator to provide Letting Services for the Residence and the Operator accepts the appointment. The appointment of the Operator is exclusive.
3.2 The Owner hereby grants to the Operator the sole and exclusive right with all necessary authority to operate and manage the letting of the Residence to Tenants in accordance with the terms of this Agreement including such things as:
(a) terminating tenancies and/or visits of occupiers of the Residence for noisy, offensive or unlawful behaviour;
(b) inform others (including the police) of information necessary to eject and/or prosecute offensive guests, visitors and Tenants; and
(c) any other actions as is necessary to operate and manage the Residence.
3.3 The Owner will not during the Term of this Agreement let or agree to let the Residence nor grant any license or other rights in relation to the Residence to any other person for the provision of services similar to that of the Operator subject to the owner’s Occupancy Rights pursuant to clause 5.3.
3.4 Upon signing this Agreement, the Owner will provide to the Operator all keys (hard and magnetic keys), security tags, manuals for any of the Contents and any other items required for the use and security of the Residence in order for the Operator to manage the Residence pursuant to this Agreement.
Appointment of the Operator. The Owner hereby appoints the Operator to provide the Operator Services and the Operator hereby accepts such appointment, in each case in accordance with and subject to the terms of this Agreement.
