Appointments and Transfers. 11.03 When circumstances require that the Employer to hire a new Employee to fill a vacancy before the pending completion of the posting and selection processtransactions contemplated in Article 11, any the appointment shall be made on a temporary or casual basis only. 11.04 When making transfers and filling vacant positions covered by this Collective Agreement vacancies within the Employer shall apply a consistent selection process. The bargaining unit, the determining factors shall be the most requisite job-job related skills, training, knowledge, experience knowledge and other qualities, and characteristics which bear a reasonable relationship to the responsibilities and requirements of the position, relevant attributes and where these factors are relatively equalconsidered by the Employer to be equal and satisfactory, seniority shall be the deciding factor. Applicants from the site(s) where the vacancy exists shall be given first consideration.
11.05 All applicants for a posted transfer and/or vacancy, shall be informed in writing of their acceptance or rejection within five (5) working days of the date of the appointment. The Union shall be advised of the successful candidate. The Employer shall confirm in writing to the Employee at the time of hire or transfer, the classification and rate of pay for the position they are filling.

In circumstances where the former position is unavailable, the Employer shall assign the Employee to a leave similar position consistent with their abilities and/or qualifications, which position may not be the specific position or in the specific area occupied prior to the transfer. The rate of absence granted pay for a period known to be longer than three (3) months, such position shall be posted as at a temporary rate of pay equivalent to that of their former position.
(b) In the event that an Employee returns to their former position pursuant to Article 11.0111.06(a), the Employer shall have one (1) opportunity to fill the resultant vacancy by selecting from the applicants on the original posting. Should the Employer exercise this right the posting provisions of this Article will be deemed to be satisfied.
(ic) Where such An Employee who is transferred before completing their initial probationary period shall complete the initial probationary period as well as the trial period in Article 11.06(a) above.
11.07 The foregoing provisions shall be waived and inoperative when placement of an Employee in a vacancy job within the bargaining unit is effected by the Employer’s and Union’s obligation to accommodate an Employee.
11.08 A Regular Employee who applies for and is successful on a temporary posting shall maintain their status as a Regular Employee. A Casual Employee who applies for and is successful for a temporary position has been filled by the appointment of shall receive all entitlements and benefits applicable to a Regular Full-time or Part-time Temporary Employee, and where, at . At the completion of the expected term of the temporary positionterm, the Employer decides that Regular Employee shall return to their former position. (iii) At the termination of a temporary position, the Employer shall endeavour to reinstate a Regular Employee in her former position, and if such reinstatement is not possible, place the Employee in another suitable regular position within the bargaining unit, and at a rate of pay equivalent to her former position. The reinstatement or placement of an Employee in accordance with this provision shall not be construed as a violation of the job posting or scheduling provisions.
(c) During the term of a temporary position, the incumbent Employee shall be eligible to apply on postings in accordance with the following:
(i) Such Employee shall be eligible to apply on postings of regular vacancies pursuant to Article 11.01 (a).
(ii) During the first (1st) six (6) months of the temporary position, such Employee shall not be eligible to apply on postings of vacancies pursuant to Article 11.06 (a), unless the position posted commences after the expiry of the term for which she was hired.

The trial period may be extended by the number of working hours absent for any reason during the trial period. During the trial period, the Employee may either:
a) return to the Employee’s former position, at the Employee’s request; or be returned to the Employee’s former position. In the event that an Employee returns to her former position pursuant to Article the Employer shall have one (1) opportunity to fill the resultant vacancy by selecting from the applicants on the original posting. Should the Employer exercise this right, the posting provisions of this Article will be deemed to be satisfied. In circumstances where reinstatement is not possible, the Employer decides that may assist the Employee finding a position consistent with her abilities qualifications, which may not be the specific position or in the specific area occupied prior to the transfer. When an Employee is no longer required transferred or transfers to a lower rated position the Employee shall retain the same increment step in that positionthe lower rated position which she previously held.
