Appraisal Guidelines. Vendor and Citizens Appraiser shall comply with any Appraisal guidelines issued by Citizens and communicated to Vendor.
Appraisal Guidelines. (1) Within 30 (thirty) days, the Board or a designated committee shall develop and implement a program to ensure that collateral dependent loans have adequate appraisals or evaluations that reflect current values. Updated appraisals or evaluations should be obtained in accordance with 12 C.F.R. Part 34, for each parcel of real property that represents primary collateral behind any extension of credit where: (a) the loan was criticized in the XXX or by the Bank's internal loan review, and the most recent independent appraisal is more than twelve (12) months old; or (b) accrued interest or loan fees have been or will be added to the outstanding principal balance, and the most recent independent appraisal is more than twelve (12) months old. (2) If evaluations are performed by bank personnel, the Board shall ensure that such personnel is competent and independent of the transaction. (3) All such appraisals and evaluations shall be completed within 90 (ninety) days, and certification by the Board or a designated committee attesting to the completion of the appraisals and evaluations shall be forwarded to the Assistant Deputy Comptroller within 30 (thirty) days thereafter. (4) The Board shall ensure that the Bank has processes, personnel, and control systems to ensure implementation of and adherence to the program developed pursuant to this Article. (5) The Board or a designated committee shall ensure that measures are implemented to achieve compliance with supervisory loan to value guidelines as per 12 CFR Part 34 by March 31, 2009.

  • Sub-Advisor Compliance Policies and Procedures The Sub-Advisor shall promptly provide the Trust CCO with copies of: (i) the Sub-Advisor’s policies and procedures for compliance by the Sub-Advisor with the Federal Securities Laws (together, the “Sub-Advisor Compliance Procedures”), and (ii) any material changes to the Sub-Advisor Compliance Procedures. The Sub-Advisor shall cooperate fully with the Trust CCO so as to facilitate the Trust CCO’s performance of the Trust CCO’s responsibilities under Rule 38a-1 to review, evaluate and report to the Trust’s Board of Trustees on the operation of the Sub-Advisor Compliance Procedures, and shall promptly report to the Trust CCO any Material Compliance Matter arising under the Sub-Advisor Compliance Procedures involving the Sub-Advisor Assets. The Sub-Advisor shall provide to the Trust CCO: (i) quarterly reports confirming the Sub-Advisor’s compliance with the Sub-Advisor Compliance Procedures in managing the Sub-Advisor Assets, and (ii) certifications that there were no Material Compliance Matters involving the Sub-Advisor that arose under the Sub-Advisor Compliance Procedures that affected the Sub-Advisor Assets. At least annually, the Sub-Advisor shall provide a certification to the Trust CCO to the effect that the Sub-Advisor has in place and has implemented policies and procedures that are reasonably designed to ensure compliance by the Sub-Advisor with the Federal Securities Laws.

  • Investment Guidelines In addition to the information to be provided to the Sub-Advisor under Section 2 hereof, the Trust or the Advisor shall supply the Sub-Advisor with such other information as the Sub-Advisor shall reasonably request concerning the Fund’s investment policies, restrictions, limitations, tax position, liquidity requirements and other information useful in managing the Fund’s investments.
