Apprenticeship Training. Section 1. The Apprenticeship and Training Program is an organized, written plan embodying the terms and conditions of employment and training, and supervision of one or more apprentices, designated as Apprenticeship Standards for Cement Xxxxxx Xxxxx #000 - Xxxx #000. There shall be a State Joint Apprenticeship Committee consisting of the “Board of Trustees” of the Agreement and Declaration of Trust. There shall be an Area Joint Apprenticeship and Training Committee, with equal representation from the Employers and the Union, and this Committee shall administer the apprenticeship and training programs for its Area. The “Duties of the Area Joint Apprenticeship Committee” is written in the Apprenticeship Standards. The Area Joint Apprenticeship Committee shall have full power to act on matters pertaining to the transferring of apprentice(s) from one job to another in order to provide diversity of training and work opportunities. One (1) apprentice shall be allowed each employer for the first journeyman cement xxxxx working on the job and one (1) additional apprentice to each three (3) additional journeyman cement masons working on the job. The ratio may be wavered by the local joint apprenticeship committee for a temporary period of time if the need arises. The State Board of Trustees Coordinator shall be notified as to the wavered ratio and the period of time it is to be in effect. All apprentices must attend all schooling and/or off-the-job training required by the relevant Area Joint Apprenticeship & Training Committee. On any job where there are two (2) or more journeyman cement masons working, Local #692 - Area #821 reserves the right to place one (1) apprentice on such job. The Apprenticeship Standards may be registered with the Bureau of Apprenticeship and Training, Employment Training Administration, U.S. Department of Labor. Section 2. The pay rate established for the Tender is a minimum rate. The Employer, at his sole discretion, may pay the Tenders a wage greater that the established rate without subjecting the Tenders to reclassification. Contributions to the Health & Welfare benefits will begin for Class C Tenders after ninety (90) days entry as a Tender. The Employer is not required to make any contributions to the pension fund for any hours worked by a Tender. The Employer at his sole discretion will assign all Tenders. Tenders will be assigned by the Employer to perform any work by the craft, including but not limited to all tamping of soil, raking, spreading, shoveling, dumping of concrete, striking or rod off to proper grade and vibrating of concrete, and which is within the individual’s capability. The Employer will provide to the Union the name and Social Security number of all Pre-Apprentices/Tenders working for the Employer. The Per-Apprentice will work under the supervision of another Cement Xxxxx in the bargaining unit outlined in this agreement. This section concerning Pre- Apprentice (Tender) will only be used by mutual consent of the Union and the Employer. Section 4. Each signatory party will receive a copy of the AGREEMENT AND DECLARATION OF TRUST. The AGREEMENT AND DECLARATION OF TRUST and the Fund are created, established and maintained, for the purpose of providing such benefits as now are, or hereafter may be, authorized and permitted by law for Participants and in accordance with its provisions written within and in the Apprenticeship Program, Journeyman Upgrading Training Program and in the Funds other rules and regulations authorized and/or created within the AGREEMENT AND DECLARATION OF TRUST. It is understood, however, that the Journeyman Upgrading Training Program will be created and maintained at the discretion of the Trustees of the Fund, as opposed to the Apprenticeship Training Program whose existence is mandated by this Trust Agreement. All Employers subject to the terms of this agreement shall contribute the amount of monies specified as the Apprenticeship Fund under Article VII - Section 1 entitled Wage Rates shall be made in a manner prescribed by the BOARD OF TRUSTEES of the AGREEMENT AND DECLARATION OF TRUST but shall be reported upon the same reporting form as is used in reporting contributions to other fringe benefits and Employers may be privileged to make contributions to separate funds in a single payment by bank check. One The terms shall be staggered, with one
(1) apprentice term from each side expiring each year. JATC members shall complete their appointed term unless removed for cause by the party they represent, or they voluntarily resign. All vacancies shall be allowed each employer filled immediately. The JATC shall select from its membership, but not both from the same party, a Chairman and a Secretary who shall retain voting privileges. The JATC will maintain one (1) set of minutes for JATC Committee meetings and a separate set of minutes for Trust meetings. The JATC should meet on a monthly basis, and also upon the first journeyman cement xxxxx working call of the Chairman.
4.3 Any issue concerning an apprentice, or an apprenticeship matter shall be referred to the JATC for its review, evaluation, and resolve, as per standards and policies. If the JATC deadlocks on any issue, the job matter shall be referred to the Labor-Management Committee for resolution as outlined in Article I of this Agreement; except for trust fund matters, which shall be resolved as stipulated in the local trust instrument.
4.4 There shall be only one (1) JATC and one (1) additional apprentice to each three (3) additional journeyman cement masons working on the joblocal apprenticeship and training trust. The ratio JATC may, however, establish joint subcommittees to meet specific needs, such as residential or telecommunications apprenticeship. The JATC may also establish a subcommittee to oversee an apprenticeship program within a specified area of the jurisdiction covered by this Agreement. All subcommittee members shall be wavered appointed, in writing, by the local joint party they represent. A subcommittee member may or may not be a member of the JATC.
4.5 The JATC may select and employ a part-time or full-time Training Director and other support staff, as it deems necessary. In considering the qualifications, duties, and responsibilities of the Training Director, the JATC should review the Training Director's Job Description provided by the Electrical Training Alliance. All employees of the JATC shall serve at the pleasure and discretion of the JATC.
4.6 To help ensure diversity of training, provide reasonable continuous employment opportunities, and comply with apprenticeship committee rules and regulations, the JATC, as the program sponsor, shall have full authority for a temporary period of time if the need arisesissuing all job training assignments and for transferring apprentices from one employer to another. The State Board of Trustees Coordinator Employer shall cooperate in providing apprentices with needed work experiences. The Local Union referral office shall be notified as notified, in writing, of all job training assignments. If the Employer is unable to provide reasonable continuous employment for apprentices, the wavered ratio and the period of time it JATC is to be in effect. so notified.
4.7 All apprentices must attend all schooling and/or off-the-job training required shall enter the program through the JATC as provided for in the registered apprenticeship standards and selection procedures. An apprentice may have their indenture canceled by the relevant Area Joint Apprenticeship & Training CommitteeJATC at any time prior to completion as stipulated in the registered standards. On Time worked and accumulated in apprenticeship shall not be considered for local union referral purposes until the apprentice has satisfied all conditions of apprenticeship. Individuals terminated from apprenticeship shall not be assigned to any job where there in any classification, or participate in any related training, unless they are reinstated in apprenticeship as per the standards, or they qualify through means other than apprenticeship, at some time in the future, but no sooner than two (2) or more journeyman cement masons workingyears after their class has completed apprenticeship, Local #692 - Area #821 reserves the right and they have gained related knowledge and job skills to place one (1) apprentice on warrant such jobclassifications.
4.8 The JATC will select and indenture a sufficient number of apprentices to meet local manpower needs. The Apprenticeship Standards JATC is authorized to indenture the number of apprentices necessary to meet the job site ratio as per Section 4.12.
4.9 Though the JATC cannot guarantee any number of apprentices, if a qualified employer requests an apprentice, the JATC shall make every effort to honor the request. If unable to fill the request within ten (10) working days, the JATC shall select and indenture the next available person from the active list of qualified applicants. An active list of qualified applicants shall be maintained by the JATC as per the selection procedures.
4.10 To accommodate short-term needs when apprentices are unavailable, the JATC shall assign unindentured workers who meet the basic qualifications for apprenticeship. Unindentured workers shall not remain employed if apprentices become available for OJT assignment. Unindentured workers shall be used to meet the job site ratios except on wage-and-hour (prevailing wage) job sites. Before being employed, the unindentured worker must sign a letter of understanding with the JATC and the employer - agreeing that they are not to accumulate more than two thousand (2,000) hours as an unindentured, that they are subject to replacement by indentured apprentices and that they are not to work on wage-and-hour (prevailing wage) job sites. Should an unindentured worker be selected for apprenticeship, the JATC will determine, as provided for in the apprenticeship, if some credit for hours worked as an unindentured worker will be applied toward the minimum OJT hours of apprenticeship. The JATC may elect to offer voluntary related training to unindentured, such as Math Review, English, Safety, Orientation/Awareness, Introduction to OSHA, First-Aid and CPR. Participation shall be voluntary.
4.11 The Employer shall contribute to the local health and welfare plans and to the National Electrical Benefit Fund (NEBF) on behalf of all apprentices and unindentured workers. Contributions to other benefit plans may be registered with the Bureau addressed in other sections of Apprenticeship and Training, Employment Training Administration, U.S. Department of Labor. 4.13 An apprentice is to be under the supervision of a Journeyman Xxxxxxx at all other worktimes. This ratio does not imply that the apprentice must always be in-sight of a Journeyman Xxxxxxx. Journeymen are not required to constantly watch the apprentice. Supervision will not be of a nature that prevents the development of responsibility and initiative. Work may be laid out by the employer’s designated supervisor or journeyman based on their evaluation of the apprentice's skills and ability to perform the job tasks. Apprentices shall be permitted to perform job tasks in effect order to develop job skills and trade competencies. Journeymen are permitted to leave theimmediatework area without being accompanied by the apprentice. Apprentices who have satisfactorily completed the first four years of related classroom training using the Electrical Training Alliance curriculum and accumulated a minimum of 6,500 hours of OJT with satisfactory performance, shall be permitted to work alone on a company wide basis any job site and receive work assignments in the area same manner as a Journeyman Xxxxxxx. An apprentice shall not be the first person assigned to a job site and apprentices shall not supervise the work of others.
4.14 Upon satisfactory completion of apprenticeship, the JATC shall issue all graduating apprentices an appropriate diploma from the Electrical Training Alliance. Each signatory party will receive a copy of the AGREEMENT AND DECLARATION OF TRUST. The AGREEMENT AND DECLARATION OF TRUST and the Fund are created, established and maintained, for the purpose of providing such benefits as now are, or hereafter may be, authorized and permitted by law for Participants and in accordance with its provisions written within and in the Apprenticeship Program, Journeyman Upgrading Training Program and in the Funds other rules and regulations authorized and/or created within the AGREEMENT AND DECLARATION OF TRUST. It is understood, however, that the Journeyman Upgrading Training Program will be created and maintained at the discretion of the Trustees of the Fund, as opposed to the Apprenticeship Training Program whose existence is mandated by this Trust Agreement. All Employers subject to the terms of this agreement shall contribute the amount of monies specified as the Apprenticeship Fund under Article VII - Section 1 entitled Wage Rates shall be made in a manner prescribed by the BOARD OF TRUSTEES of the AGREEMENT AND DECLARATION OF TRUST but shall be reported upon the same reporting form as is used in reporting contributions to other fringe benefits and Employers may be privileged to make contributions to separate funds in a single payment by bank check. Should the APPRENTICESHIP PROGRAM, for any reason, be abandoned at the State level, the contributions called for herein shall be disbursed in the manner set forth in the most current Trust Document.

Apprenticeship Training. Section 1. The Apprenticeship and Training Program is an organized, written plan embodying the terms and conditions of employment and training, and supervision of one or more apprentices, designated as Apprenticeship Standards for Cement Xxxxxx Xxxxx #000 - Xxxx #000. 5.01 There shall be a State Joint Apprenticeship Committee consisting of the “Board of Trustees” of the Agreement and Declaration of Trust. There shall be an Area local Joint Apprenticeship and Training Committee, with equal representation from Committee (JATC) consisting of a total of either 6 or 8 members who shall also serve as Trustees to the Employers and the Union, and this Committee shall administer the local apprenticeship and training programs for its Areatrust. An equal number of members (either 3 or 4) shall be appointed, in writing, by the local chapter of the National Electrical Contractors Association (NECA) and the local union of the International Brotherhood of Electrical Workers (IBEW). The “Duties local apprenticeship standards shall be in conformance with national guideline standards and industry policies to ensure that each apprentice has satisfactorily completed the NJATC required hours and course of study. Section 5.02 All JATC member appointments, re-appointments and acceptance of appointments shall be in the Apprenticeship Standardswriting. Each member shall be appointed for a (4) Four year term, unless being appointed for a lesser period of time to complete an unexpired term. The Area Joint Apprenticeship Committee terms shall have full power to act on matters pertaining to the transferring of apprentice(s) from be staggered, with one job to another in order to provide diversity of training and work opportunities. One (1) apprentice term from each side expiring each year. JATC members shall complete their appointed term unless removed for cause by the party they represent or they voluntarily resign. All vacancies shall be allowed each employer filled immediately. The JATC shall select from its membership, but not both from the same party, a Chairman and a Secretary who shall retain voting privileges. The JATC will maintain one (1) set of minutes for JATC committee meetings and a separate set of minutes for Trust meetings. The JATC should meet on a monthly basis, and also upon the first journeyman cement xxxxx working call of the Chairman.
Section 5.03 Any issue concerning an apprentice or an apprenticeship matter shall be referred to the JATC for its review, evaluation, and resolve; as per standards and policies. If the JATC deadlocks on any issue, the job matter shall be referred to the Labor-Management Committee for resolution as outlined in Article I of this agreement; except for trust fund matters, which shall be resolved as stipulated in the local trust instrument.
Section 5.04 There shall be only one (1) JATC and one (1) additional apprentice to each three (3) additional journeyman cement masons working on the joblocal apprenticeship and training trust. The ratio may be wavered by the local JATC may, however, establish joint apprenticeship committee for a temporary period of time if the need arisessubcommittees to meet specific needs, such as residential or telecommunication apprenticeship. WAGES 1st Period 0 to 800 Hrs - 60% of Journeyman Rate 2nd Period 801 to 1600 Hrs - 70% of Journeyman Rate 3rd Period 1601 to 2400 Hrs - 75% of Journeyman Rate 4th Period 2401 to 3200 Hrs - 80% of Journeyman Rate 5th Period 3201 to 4000 Hrs - 85% of Journeyman Rate 6th Period 4001 to 4800 Hrs - 90% of Journeyman Rate 7th Period 4801 to 5600 Hrs - 95% of Journeyman Rate When classes are in session during the school, the apprentice(s) must satisfactorily complete related technical training prior to receiving period wage increases. 4.5 The JATC may select and employ a part-time or full-time Training Director and other support staff, as it deems necessary. In considering the qualifications, duties and responsibilities of the Training Director, the JATC should review the Training Director's Job Description provided by the NJATC. All employees of the JATC shall serve at the pleasure and discretion of the JATC.
4.6 To help ensure diversity of training, provide reasonable continuous employment opportunities and comply with apprenticeship committee rules and regulations, the JATC, as the program sponsor, shall have full authority for a temporary period of time if the need arisesissuing all job training assignments and for transferring apprentices from one employer to another. The State Board of Trustees Coordinator Employer shall cooperate in providing apprentices with needed work experiences. The Local Union referral office shall be notified as notified, in writing, of all job training assignments. If the Employer is unable to provide reasonable continuous employment for apprentices, the wavered ratio and the period of time it JATC is to be in effect. so notified.
4.7 All apprentices must attend all schooling and/or off-the-job training required shall enter the program through the JATC as provided for in the registered apprenticeship standards and selection procedures. An apprentice may have their indenture canceled by the relevant Area Joint Apprenticeship & Training CommitteeJATC at any time prior to completion as stipulated in the registered standards. On Time worked and accumulated in apprenticeship shall not be considered for local union referral purposes until the apprentice has satisfied all conditions of apprenticeship. Individuals terminated from apprenticeship shall not be assigned to any job where there in any classification, or participate in any related training, unless they are reinstated in apprenticeship as per the standards, or they qualify through means other than apprenticeship, at sometime in the future, but no sooner than two (2) or more journeyman cement masons workingyears after their class has completed apprenticeship, Local #692 - Area #821 reserves the right and they have gained related knowledge and job skills to place one (1) apprentice on warrant such jobclassifications.
4.8 The JATC will select and indenture a sufficient number of apprentices to meet local manpower needs. The Apprenticeship Standards JATC is authorized to indenture the number of apprentices necessary to meet the job site ratio as per Section 4.12.
4.9 Though the JATC cannot guarantee any number of apprentices, if a qualified employer requests an apprentice, the JATC shall make every effort to honor the request. If unable to fill the request within ten (10) working days, the JATC shall select and indenture the next available person from the active list of qualified applicants. An active list of qualified applicants shall be maintained by the JATC as per the selection procedures.
4.10 To accommodate short-term needs when apprentices are unavailable, the JATC shall assign unindentured workers who meet the basic qualifications for apprenticeship. Unindentured workers shall not remain employed if apprentices become available for OJT assignment. Unindentured workers shall be used to meet the job site ratios except on wage-and-hour (prevailing wage) job sites. Before being employed, the unindentured person must sign a letter of understanding with the JATC and the employer - agreeing that they are not to accumulate more than two thousand (2,000) hours as an unindentured, that they are subject to replacement by indentured apprentices and that they are not to work on wage-and-hour (prevailing wage) job sites. Should an unindentured worker be selected for apprenticeship, the JATC will determine, as provided for in the apprenticeship, if some credit for hours worked as an unindentured will be applied toward the minimum OJT hours of apprenticeship. The JATC may elect to offer voluntary related training to unindentured; such as Math Review, English, Safety, Orientation/Awareness, Introduction to OSHA, First-Aid and CPR. Participation shall be voluntary.
4.11 The Employer shall contribute to the local health and welfare plans and to the National Electrical Benefit Fund (NEBF) on behalf of all apprentices and unindentured. Contributions to other benefit plans may be registered with the Bureau addressed in other sections of Apprenticeship and Training, Employment Training Administration, U.S. Department of Labor. A job site is considered to be the physical location where employee report for their work assignments. The Employer's shop (service center) is considered to be a separate, single job site. All other physical locations where workers report to work are each considered to be a single separate job site.
4.13 An apprentice is to be under the supervision of a Journeyman Xxxxxxx at all other worktimes. This ratio does not imply that the apprentice must always be in-sight of a Journeyman Xxxxxxx. Journeyman are not required to constantly watch the apprentice. Supervision will not be of a nature that prevents the development of responsibility and initiative. Work may be laid out by the employer’s designated supervisor or journeyman based on their evaluation of the apprentice's skills and ability to perform the job tasks. Apprentices shall be permitted to perform job tasks in effect order to develop job skills and trade competencies. Journeymen are permitted to leave the immediate work area without being accompanied by the apprentice. Apprentices who have satisfactorily completed the first four years of related classroom training using the NJATC curriculum and accumulated a minimum of 6,500 hours of OJT with satisfactory performance, shall be permitted to work alone on a company wide basis any job site and receive work assignments in the area same manner as a Journeyman Xxxxxxx. An apprentice shall not be the first person assigned to a job site and apprentices shall not supervise the work of others.
4.14 Upon satisfactory completion of apprenticeship, the JATC shall issue all graduating apprentices an appropriate diploma from the NJATC. The JATC shall encourage each graduating apprentice to apply for college credit through the NJATC. The JATC may also require each apprentice to acquire any electrical license required for journeymen to work in the jurisdiction covered by this Agreement. There will .
4.15 The parties to this Agreement shall be no restrictions on the work performed bound by the TendersLocal Joint Apprenticeship and Training Trust Fund Agreement which shall conform to Section 302 of the Labor-Management Relations Act of 1947 as amended, ERISA and other applicable regulations. The current rate of contribution is eighty ($ .80) cents per hour for each hour worked Twenty cents ($ .20) of the current contribution, which is allocated by the membership, is earmarked for the JATC Building Fund under Article VII - Section 1 entitled Wage Rates and will sunset on May 31, 2022. Classes will be held from September through May each school year for a minimum of 144 hours per year; for 3 years, totaling a minimum of 432 hours over the term of apprenticeship.
Section 3. PRE-APPRENTICE (TENDERS) Pre-Apprentice (Tender) Tender: (Minimum Wage Rates) Paid per Hour Worked C – Classification – Up to One (1) year employment $11.55 B – Classification – One to Two (2) years employment $12.55 A – Classification – Two (2) or more years employment $13.55 Health & Welfare $ 4.35 Apprentice 0.40 IUCRC 0.07 International Dues (Deduct) (0.29) Work Dues (Deduct) (1.31) Health & Welfare contributions will begin in Class C Tenders after 90 days entry as a Tender. Tenders may be utilized in a ratio not to exceed three (3) tenders to one (1) journeyman on patching and rubbing work and a ratio of one (1) tender to one (1) journeyman on all other work. This ratio will be in effect on a company wide basis in the area covered by this Agreement. There will be no restrictions on the work performed by the Tenders. The pay rate established for the Tender is a minimum rate. The Employer, at his sole discretion, may pay the Tenders a wage greater that the established rate without subjecting the Tenders to reclassification. Contributions to the Health & Welfare benefits will begin for Class C Tenders after ninety (90) days entry as a Tender. The Employer is not required to make any contributions to the pension fund for any hours worked by a Tender. The Employer at his sole discretion will assign all Tenders. Tenders will be assigned by the Employer to perform any work by the craft, including but not limited to all tamping of soil, raking, spreading, shoveling, dumping of concrete, striking or rod off to proper grade and vibrating of concrete, and which is within the individual’s capability. The Employer will provide to the Union the name and Social Security number of all Pre-Apprentices/Tenders working for the Employer. The Per-Apprentice will work under the supervision of another Cement Xxxxx in the bargaining unit outlined in this agreement. This section concerning Pre- Apprentice (Tender) will only be used by mutual consent of the Union and the Employer.
Section 4. APPRENTICESHIP & TRAINING TRUST FUND The parties signatory hereto to participate and be a party to the “AGREEMENT AND DECLARATION OF TRUST - OP & CMIA LOCAL UNION #692 CEMENT XXXXX APPRENTICE TRAINING AND JOURNEYMAN RETRAINING EDUCATION FUND”. Each signatory party will receive a copy of the AGREEMENT AND DECLARATION OF TRUST. The AGREEMENT AND DECLARATION OF TRUST and the Fund are created, established and maintained, for the purpose of providing such benefits as now are, or hereafter may be, authorized and permitted by law for Participants and in accordance with its provisions written within and in the Apprenticeship Program, Journeyman Upgrading Training Program and in the Funds other rules and regulations authorized and/or created within the AGREEMENT AND DECLARATION OF TRUST. It is understood, however, that the Journeyman Upgrading Training Program will be created and maintained at the discretion of the Trustees of the Fund, as opposed to the Apprenticeship Training Program whose existence is mandated by this Trust Agreement. All Employers subject to the terms of this agreement shall contribute the amount of monies specified as the Apprenticeship Fund under Article VII - Section 1 entitled Wage Rates shall be made in a manner prescribed by the BOARD OF TRUSTEES of the AGREEMENT AND DECLARATION OF TRUST but shall be reported upon the same reporting form as is used in reporting contributions to other fringe benefits and Employers may be privileged to make contributions to separate funds in a single payment by bank check. Should the APPRENTICESHIP PROGRAM, for any reason, be abandoned at the State level, the contributions called for herein shall be disbursed in the manner set forth in the most current Trust Document.

Apprenticeship Training. Section 1. The Apprenticeship 7.1 It is further agreed that all newly registered Carpentry-Apprentices shall be indentured to the Local Carpentry Certification Act and be subject to all provisions as set forth in the Agreement.
7.2 All Apprentices shall be employed in accordance with the provisions of the New Brunswick Industrial Training Program is an organized, written plan embodying the terms and conditions of employment and trainingCertification Act, and supervision of one or more apprentices, designated as Apprenticeship Standards for Cement Xxxxxx Xxxxx #000 - Xxxx #000. There shall be a State Joint Apprenticeship Committee consisting the parties hereto agree to observe all provisions of the “Board of Trustees” said Act.
7.3 To further develop and improve the qualifications of the Agreement and Declaration of Trust. There shall be an Area Joint Apprenticeship and Training Apprentice, it is agreed by all parties named –
(a) Local Advisory Committee, (b) Apprentice, and (c) Employers – after consultation with equal representation the parties involved, the Local Carpentry Advisory Committee reserves the right to refer an Apprentice from one phase or operation of a job, or from one Employer to another, in order that the Employers Apprentice will receive adequate practical coverage of the trade. Apprentices also must have their book stamped by the Department of Labour for the purposes of this Agreement. Any Apprentice not indentured and registered through the Department of Labour will not be upgraded without the joint consent of the Employer and the Union, and this Committee shall administer the apprenticeship and training programs for its Area. .
7.4 The “Duties ratio of the Area Joint Apprenticeship Committee” is written in the Apprenticeship Standards. The Area Joint Apprenticeship Committee shall have full power Apprentices to act on matters pertaining to the transferring of apprentice(s) from one job to another in order to provide diversity of training and work opportunities. One (1) apprentice Journeyman shall be allowed each employer for the first journeyman cement xxxxx working on the job and one (1) additional apprentice to each three (3) additional journeyman cement masons working on the job. The ratio may be wavered by the local joint apprenticeship committee for a temporary period of time if the need arises. The State Board of Trustees Coordinator shall be notified as to the wavered ratio and the period of time it is to be in effect. All apprentices must attend all schooling and/or off-the-job training required by the relevant Area Joint Apprenticeship & Training Committee. On any job where there are two (2) or more journeyman cement masons working, Local #692 - Area #821 reserves the right to place one (1) apprentice on such job. The pay rate established for the Tender is a minimum first 1000 hours, sixty percent (60%) of the Journeyman’s rate. The Employer, at his sole discretion, may pay the Tenders a wage greater that the established rate without subjecting the Tenders to reclassification. Contributions to the Health & Welfare benefits will begin for Class C Tenders after ninety adjusted as follows: 70% (1000 hours – 2500 hours) 80% (First Sector completed) 85% (Second Sector completed) 90% (Third Sector completed) days entry as a Tender. The Employer is not required to make any contributions to the pension fund for any hours worked by a Tender. The Employer at his sole discretion will assign all Tenders. Tenders will be assigned by the Employer to perform any work by the craft, including but not limited to all tamping of soil, raking, spreading, shoveling, dumping of concrete, striking or rod off to proper grade and vibrating of concrete, and which is within the individual’s capability. The Employer will provide to the Union the name and Social Security number of all Pre-Apprentices/Tenders working for the Employer. If an Apprentice fails to go to Department of Manpower training courses when they are scheduled, they shall not receive incremental increases. (A Committee of Union and in Employer Representatives from the Apprenticeship Program, Journeyman Upgrading Training Program negotiating committee will decide which modules from the Department of Manpower and in the Funds other rules and regulations authorized and/or created within the AGREEMENT AND DECLARATION OF TRUST. It is understood, however, that the Journeyman Upgrading Labour Training Program will be created included in the above SECTORS and maintained at the discretion of the Trustees of the Fund, as opposed to the Apprenticeship Training Program whose existence is mandated by this Trust Agreement. 7.7 The Union and the Employer agree to co-operate in the most current Trust Documentformulation and development of apprenticeship programs. Any apprenticeship program will include provisions to promote hiring and training opportunities for women, First Nation members, and other groups identified in the Human Rights Act.
