Asbestos Certification. Architect shall certify to DISTRICT, in writing and under penalty of perjury, that to the best of its knowledge, information and belief no asbestos- containing material or other material deemed to be hazardous by the state or federal government was specified as a building material in any construction document that the Architect prepares for the Project. Architect shall require all consultants who prepare any other documents for the Project to submit the same written certification. Architect shall also assist the DISTRICT in ensuring that contractors provide DISTRICT with certification, in writing and under penalty of perjury, that to the best of their knowledge, information and belief no material furnished, installed or incorporated into the Project contains asbestos or any other material deemed to be hazardous by the state or federal government. These certifications shall be part of the final Project submittal. Architect shall include statements in its specifications that materials containing asbestos or any other material deemed to be hazardous by the state or federal government are not to be included.

Asbestos Certification. Pursuant to 40 Code of Federal Regulations, Section 763.99(a)(7), Architect shall certify to its best information that no asbestos-containing material was specified as a building material in any construction document for the Project and will reasonably endeavor to compel contractors to provide Owner with certification that all materials used in the construction of any school building are free from any asbestos-containing building materials (“ACBMs”). This certification shall be part of the final project submittal. Architect shall include statements in specifications that materials containing asbestos are not to be included.
Asbestos Certification. No contractor shall engage in asbestos-related work, as defined in Section 6501.8 of the Labor Code, which involved 100 square feet or more of surface area of asbestos containing materials, unless the qualifier for the license passes an asbestos certification examination. Additional updated certification examination shall be made by Contractors’ State License Board, in consultation with the Division of Occupational Safety and Health in the Department of Industrial Relations and the State Department of Health Services. Architect shall require all consultants who prepare any other documents for the Project to submit the same written certification. Architect shall also assist the District in ensuring that contractors provide District with certification, in writing and under penalty of perjury, that to the best of their knowledge, information and belief no material furnished, installed or incorporated into the Project contains asbestos. The District understands that the Architect is not qualified to make a determination as to the existence of hazardous materials in existing materials on site, and will not be held liable in the event of the discovery of existing hazardous materials. The District shall employ testing agencies having the licensure and expertise required to conduct the investigation and remediation of hazardous materials.
