ASSISTANCE IN LEGAL PROCEEDINGS. 20.1 To the extent that the institution and defence of necessary litigation arising out of or in connection with the provision of the [ ] Shared Service during the Service Period is not undertaken by an insurer acting for any of the Authorities it shall be undertaken by the legal advisors for such of the Authorities as may be agreed by the Board. 20.2 All claims or potential claims received by an Authority shall be notified to the Head of the [ ] Shared Service, the MKSD and the Board within seven days. 20.3 Each Authority will provide all reasonable assistance to the other Authorities (and their insurers) as the case may be in defending any claims and, if requested to do so, each Authority shall provide the other with any relevant information (including but not limited to documentation or statements) in connection with any legal enquiry, arbitration, court proceedings or hearings in which the requesting Authority might become involved arising out of or pursuant to the terms of the Relevant Contracts and/or this Agreement.

ASSISTANCE IN LEGAL PROCEEDINGS. 5.4.1 If requested to do so by the Authorised Officer, the Provider shall give all reasonable assistance and co-operation and provide to the Customer any relevant information which is not confidential in connection with any legal inquiry, arbitration or court proceedings in which the Customer may become involved, or any relevant disciplinary hearing internal to the Customer, or any inquiry by the Local Government Ombudsman, arising out of the provision of the Services or the Provider‟s presence on Customer Premises. 5.4.2 Where the Provider becomes aware of any incident, accident or other matter which may give rise to a complaint to the Local Government Ombudsman or a claim or legal proceedings in respect of the provision or failure to provide the Services, it shall notify the Authorised Officer in writing as soon as practicable and in any event within 48 hours. Such notification in writing shall include all relevant information which is not confidential to enable the Authorised Officer to investigate the matter fully. 5.4.3 Such information provided or assistance rendered pursuant to clauses 5.4.1 and 5.4.2 above, in whatever form, shall be at no cost to the Customer unless otherwise ordered or determined in any decision or other outcome of any such inquiry, arbitration, court proceedings or enquiry by the Local Government Ombudsman. ASSISTANCE IN LEGAL PROCEEDINGS. ‌ 27.1 The Service Provider shall notify the Council’s Representative of‌‌ 27.1.1 any accident, damage or breach of any statutory provision relating in any way to the Service;‌‌ 27.1.2 any legal inquiry, arbitration or Court proceedings relating in any way to the Service;‌ immediately upon becoming aware of it.‌ 27.2 If requested to do so by the Council’s Representative the Service Provider shall provide the Council’s Representative with any relevant information and assistance in connection with any legal inquiry, hearing, arbitration or Court proceedings in which the Council may become involved in relation to the Service or any relevant disciplinary hearing internal to the Council and shall give evidence in such inquiries or proceedings or hearings.‌ 27.3 Should any part of the Service involve the Service Provider in performing duties or exercising powers under some other contract it shall upon becoming aware of anything which is likely to give rise to arbitration or litigation under that other contract forthwith notify the Council’s Representative of the existence of any such matter together with such particulars as are available.‌ 27.4 Assistance shall be provided by the Service Provider pursuant to this Condition 27 free of charge where it is required in relation to a matter which was caused or arose during the Contract Period. Any other assistance required by the Council shall be the subject of a modification pursuant to Condition 8.‌‌‌‌
ASSISTANCE IN LEGAL PROCEEDINGS. Both during and, subject to your obligations to any future employer or equivalent after the termination of your employment you will provide both us and any Group Company with whatever assistance may reasonably be required in connection with actual or prospective legal or regulatory proceedings or related investigations. We will pay your reasonable out-of-pocket expenses in doing so.
ASSISTANCE IN LEGAL PROCEEDINGS. Where requested by the CommissionersAdministration Manager, the Provider shall give all reasonable assistance and co-operation and provide to the Commissioners any relevant information which is not confidential in connection with any legal inquiry, arbitration or court proceedings in which the Commissioners may become involved, or any relevant disciplinary hearing internal to the Commissioners, or any inquiry by the Local Government Ombudsman, arising out of the provision of the Services. Where the Provider becomes aware of any incident, accident or other matter which may lead to a complaint to the Local Government Ombudsman or a claim or legal proceedings, in respect of the provision of or failure to provide the Services, it shall notify the Agreement Administration Manager by telephone and in writing as soon as practicable and in any event within forty eight (48) hours of becoming aware of the same. Such written notification shall include all relevant information that is not confidential to enable the Agreement Administration Manager to investigate the matter fully. Such information provided or assistance rendered pursuant to the obligations in this clause 68, in whatever form, shall be at no additional cost to the Commissioners.

If requested to do so by the Authorised Officer, the Contractor shall promptly co- operate fully with the Council (including the provision of documentation and 60.2. Such notification shall include all relevant information to enable the Authorised Officer to investigate the matter fully. 60.3. Such information provided or assistance rendered pursuant to the obligations in this Clause 60, in whatever form, shall be at no cost to the Council. 60.4. The Contractor shall be responsible for and shall indemnify the Council against all costs , claims and damages arising from an adverse finding of the Ombudsman and all costs arising in relation to any claim or legal proceedings including any compensation suggested in relation to the Services which arises from the Contractor or Staff or one of the Contractor’s sub-contractors (of any tier) or any of their employees being in breach of this Contract or from an act or omission in providing the Services.

ASSISTANCE IN LEGAL PROCEEDINGS. 9.1 If requested to do so by the Lead Partner, the other Delivery Partners shall give all reasonable assistance and co-operation and provide to the Lead Partner any relevant information which is not confidential in connection with any legal enquiry, arbitration or Court proceedings, in which the Lead Partner may become involved, or any relevant disciplinary hearing internal to the Lead Partner, or any inquiry by the Public Services Ombudsman for Wales arising out of the Project or this Agreement. 9.2 Where any Partner becomes aware of any incident, accident or other matter which may give rise to a complaint to the Public Services Ombudsman for Wales or a claim or legal proceedings in respect of the provision or failure in the Project or this Agreement, it shall notify the Project Steering Board in writing as soon as practicable and in any event within 48 hours. Such notification in writing shall include all relevant information as may reasonably be available at the time which is not confidential to enable the Project Steering Board to investigate the matter fully. 9.3 Such information provided or assistance rendered pursuant to the obligation in clauses 9.1 and 9.2 above, in whatever form, shall be at no cost to the Lead Partner unless otherwise ordered or determined in any decision or other outcome of any such inquiry, arbitrations, Court proceedings or enquiry by the Public Services Ombudsman for Wales.
ASSISTANCE IN LEGAL PROCEEDINGS. 28.1 Landlord will notify the Authorised Officer of any accident, damage or breach of any statutory provision relating in any way to the Tenancy immediately upon becoming aware of it. 28.2 If requested to do so by the Authorised Officer the Landlord shall provide the Authorised Officer with any relevant information arising out of the provision of the Tenancy, in connection with any legal inquiry, hearing, arbitration or Court proceedings in which the Council may become involved or any relevant disciplinary hearing internal to the Council and shall give evidence in such inquiries or proceedings or hearings. 28.3 Assistance shall be provided by the Landlord pursuant to this Clause without charge where it is required in relation to a matter which was caused by Xxxxxxxx’s breach of this Agreement and or by the Landlord’s negligence or by a breach or negligence by one or more of Landlord’s employees staff or a person acting with his authority.
ASSISTANCE IN LEGAL PROCEEDINGS. ‌ 36.1 If requested to do so by either Party, the other Party shall co-operate fully with the requesting Party (including, but not limited to the provision of documentation and statements from its staff) in connection with any legal proceedings, Ombudsman enquiries, inquiry, arbitration or court proceedings in which the requesting Party may become involved, or any relevant disciplinary hearing internal to the requesting Party, or Individual complaint, arising out of the provision of the Services, and the co- operating Party shall give evidence in such inquiries, arbitration, proceeding or hearings. 36.2 Where either Party or any of its staff become aware of any incident, maladministration, accident or other matter which may give rise to an Ombudsman enquiry, claim or legal proceedings in respect of the provision of, or failure to, provide the Services, it shall notify the other Party’s representative immediately in writing. Such notification shall include all relevant information to enable the Council’s Representative and the Provider to investigate the matter fully. 36.3 Such information provided or assistance rendered pursuant to the obligation in Sub Clauses 36.1 and 36.2 above, in whatever form, shall be at no cost to the Party requesting the assistance. 36.4 Any liability which the Council incurs as a result of failure by the Provider shall be recoverable in accordance with Clause 42 (Right to Set-Off).
