Assistance to the Controller. (a) The processor shall promptly notify the controller of any request it has received from the data subject. It shall not respond to the request itself, unless authorised to do so by the controller. (b) The processor shall assist the controller in fulfilling its obligations to respond to data subjects’ requests to exercise their rights, taking into account the nature of the processing. In fulfilling its obligations in accordance with (a) and (b), the processor shall comply with the controller’s instructions (c) In addition to the processor’s obligation to assist the controller pursuant to Clause 8(b), the processor shall furthermore assist the controller in ensuring compliance with the following obligations, taking into account the nature of the data processing and the information available to the processor: (1) the obligation to carry out an assessment of the impact of the envisaged processing operations on the protection of personal data (a ‘data protection impact assessment’) where a type of processing is likely to result in a high risk to the rights and freedoms of natural persons; (2) the obligation to consult the competent supervisory authority/ies prior to processing where a data protection impact assessment indicates that the processing would result in a high risk in the absence of measures taken by the controller to mitigate the risk; (3) the obligation to ensure that personal data is accurate and up to date, by informing the controller without delay if the processor becomes aware that the personal data it is processing is inaccurate or has become outdated; (4) the obligations in Article 32 Regulation (EU) 2016/679. (d) The Parties shall set out in Annex III the appropriate technical and organisational measures by which the processor is required to assist the controller in the application of this Clause as well as the scope and the extent of the assistance required.

Assistance to the Controller. 6.1 To the extent required by Applicable Laws and Regulations and taking into account the nature of the Processing and the information reasonably available, Huawei shall provide Customer with reasonable assistance with regards to: 6.1.1 ensuring compliance with Controller's obligations pursuant to Applicable Laws and Regulations; 6.1.2 making available to Controller all reasonable information necessary to demonstrate compliance with Applicable Laws and Regulations; 6.1.3 where applicable, performing the necessary data protection impact assessments and prior consultation procedures as mentioned in articles 35 and 36 GDPR, respectively; 6.1.4 providing the information contained in the Agreement including this DPA. 6.2 Where assistance requested by Customer and provided by Huawei in accordance with Clause 6.1 is not part of the Service and Huawei's regular activities related thereto, Huawei may charge Customer for the reasonable costs occurring on Huawei for such assistance.

Assistance to the Controller. 9.1 The Processor shall provide the Controller with all necessary assistance and cooperation in enforcing the obligations of the Parties under the GDPR and other applicable laws and regulations concerning the Processing of Personal Data. To the extent that such assistance relates to the Processing of Personal Data for the purpose of the performance of the agreement, the Processor shall in any event provide the Controller with such assistance relating to: (i) The security of Personal Data. (ii)Performing checks and audits. (iii)Performing DPIAs.
Assistance to the Controller. The Processor shall by appropriate technical and organisational measures reasonably assist the Controller with the Controller’s: i) compliance with, and documentation of compliance with, applicable data protection legislation; ii) obligation to implement technical and organisational measures; iii) obligation to conduct data protection impact assessments; iv) obligation to conduct prior consultations with applicable data protection authorities; Assistance as set out above shall be carried out the extent necessary, taking into account the Controller’s need, the nature of the processing and the information available to the Controller.

Unless the assistance is directly due to the processor’s breach of contract or negligence, the processor shall be entitled to a time-based remuneration for assistance extended to the controller under the agreement. (c) In addition to the processor’s obligation to assist the controller pursuant to Clause 8(b), the processor shall furthermore, at the controller’s costs assist the controller in ensuring compliance with the following obligations, taking into account the nature of the data processing and the information available to the processor: (1) the obligation to carry out an assessment of the impact of the envisaged processing operations on the protection of personal data (a ‘data protection impact assessment’) where a type of processing is likely to result in a high risk to the rights and freedoms of natural persons; (2) the obligation to consult the competent supervisory authority/ies prior to processing where a data protection impact assessment indicates that the processing would result in a high risk in the absence of measures taken by the controller to mitigate the risk; (3) the obligation to ensure that personal data is accurate and up to date, by informing the controller without delay if the processor becomes aware that the personal data it is processing is inaccurate or has become outdated; (4) the obligations in Article 32 of Regulation (EU) 2016/679/. (d) The Parties shall set out in Xxxxx XXX the appropriate technical and organizational measures by which the processor is required to assist the controller in the application of this Clause as well as the scope and the extent of the assistance required. (e) Whenever the processor is requested to provide its assistance under the Agreement, the processor shall be entitled to charge its ordinary hourly rate for providing such assistances, cf. Xxxxx XX.
Assistance to the Controller. The processor shall insofar as this is possible – within the scope and the extent of the assistance specified below – assist the controller in accordance with the DPA, Section II, Clause 8 by implementing the following technical and organisational measures: Assistance to the controller is provided by implementing a suitable set of standards and controls, including policies, processes, communication channels, procedures, organisational structures, software and hardware systems, that enable the processor to provide the right level of assistance to the controller. These controls and standards are established, implemented, monitored, reviewed and improved where necessary to ensure that the specific security and compliance objectives, as well as the purposes of the data protection law GDPR, are met. The processor has defined and implemented a policy for information security and privacy and will, for personal data, maintain the following technical and organisational measures to assist the controller: The processor, has appointed a responsible for delegating, coordinating and monitoring the security rules and procedures.

The Processor shall provide assistance in reviewing data breaches and implementing any notification obligations, as well as in complying with the obligation to ensure that personal data is accurate and up to date. Furthermore, the Processor shall assist with appropriate technical and organisational measures to enable the Controller to fulfil its existing obligations towards the data subject.
Assistance to the Controller. 5.4.1 At the Controller’s request and taking into account the nature of the pro- cessing, the Processor shall assist the Controller by appropriate technical and organizational measures, with the ful- filment of the Controller’s obligation to respond to requests for exercising the data subjects’ rights as set out in the applicable legislation on the processing of personal data. 5.4.2 At the Controller’s request and taking into account the nature of the pro- cessing and the information available to the Processor, the Processor shall al- so assist the Controller with ensuring compliance with the Controller’s obli- gations to: a) implement appropriate technical and organizational measures; b) notify the supervisory authori- ties of personal data breaches; c) communicate a personal data breach to data subjects; d) carry out data protection impact assessments; and e) perform prior consultations of the supervisory authority.
Assistance to the Controller. The Processor shall provide reasonable assistance to the Controller in relation to a claim or request related to the processing of Personal Data or investigation or assessment of the processing, including the preparation of a data protection impact assessment and cooperation related to incidents (see clause 8.1.3). The Processor helps to fulfil the obligations set forth in Articles 32-36 of the GDPR. The Processor has the right to ask for a fee for the assistance performed in accordance with a separate agreement of the Parties;
