Ballot Measure Development Clause Samples
The Ballot Measure Development clause outlines the procedures and responsibilities involved in creating and finalizing proposed measures to be placed on a ballot for public vote. Typically, this clause specifies who is authorized to draft the measure, the process for reviewing and revising its language, and any required approvals before submission. By establishing a clear framework for developing ballot measures, the clause ensures that proposals are properly vetted and formatted, reducing confusion and legal challenges during the election process.
Ballot Measure Development. Consultant shall perform the following Services as needed and requested by Client to assist Client in preparing Client’s measure for the ballot:
A. Recommend a final tax rate, duration and tax structure;
B. Recommend the final list of projects, programs and/or services to be funded by Client’s ballot measure;
C. Work with legal counsel to develop the 75-word ballot question;
D. Work with legal counsel to develop and refine the full text of Client’s ballot measure, and other materials that will appear in the ballot pamphlet mailed to all voters;
E. Present recommendations, documents and resolutions to the Governing Board for approval; and
F. Make recommendations and provide strategic advice regarding timing and planning for any other potential ballot measures considered by Client.
Ballot Measure Development. TBWBH shall perform any of the following services as needed to assist Client in preparing the Bond Measure for the ballot:
1) Recommend the list of projects to be funded by the measure and prepare messaging that clearly articulates how these projects will benefit from the Bond Measure;
2) Develop procedures for the taxpayer accountability protections, including a process for an independent citizens’ oversight committee;
3) Work with legal counsel to develop a resolution calling for the election;
4) Work with legal counsel to develop the 75-word ballot question;
5) Work with legal counsel to develop and refine the full text of the measure, project list, tax rate statement and other materials that will appear in the ballot pamphlet mailed to all voters;
6) Present recommendations, documents and resolutions to the Governing Board for approval; and
7) Work with the County Registrar of Voters Office to assist Client in completing the process of qualifying for the ballot.
Ballot Measure Development. P&M shall perform any of the following services as needed to assist Client in preparing the Bond Measure for the ballot:
1) Recommend the list of projects to be funded by the measure and prepare messaging that clearly articulates how these projects will benefit from the Bond Measure;
2) Develop procedures for the taxpayer accountability protections, including a process for an independent citizens' oversight committee;
3) Work with legal counsel to develop a resolution calling for the election;

Ballot Measure Development. TBWBH/P&M shall perform any of the following services as needed to assist Client in preparing the CFD Measure for the ballot:
1) Recommend the final list of facilities, programs and services to be funded by the measure and prepare messaging that clearly articulates how these facilities and programs will benefit from additional revenue provided by the CFD;
2) Recommend potential exemptions and procedures for qualifying for the exemptions (e.g. senior exemption applications and process);
3) Recommend taxpayer accountability protections, including a process for an independent citizens’ oversight committee;
4) Work with legal counsel to develop a resolution calling for the election;
5) Work with legal counsel to develop the 75-word ballot question;
6) Work with legal counsel to develop and refine the full text of the measure and other materials that will appear in the ballot pamphlet mailed to all voters;
Ballot Measure Development. TBWB shall perform any of the following services as needed to assist Client in preparing the Measure for the ballot:
1) Recommend specific wording regarding the list of projects to be funded by the measure and prepare messaging that clearly articulates how these projects will benefit from the Measure;
2) Recommend potential taxpayer accountability protections;
3) Work with legal counsel to help develop a resolution calling for the election;
4) Work with legal counsel to develop the 75-word ballot question;
5) Work with legal counsel to refine the full text of the measure, project list, tax rate statement and other materials that will appear in the ballot pamphlet mailed to all voters;
6) Present recommendations, documents and resolutions to the Governing Board for approval; and
7) Work with the County Registrar of Voters Office to assist Client in completing the process of qualifying for the ballot.
Ballot Measure Development. If at the conclusion of the Feasibility Assessment, the Board of Trustees (“Board”) approves further work to prepare a measure for the ballot, TBWB shall perform any of the following services as needed to assist Client in preparing the Bond Measure for the ballot:
1) Recommend the list of projects to be funded by the measure and prepare messaging that clearly articulates how these projects will benefit from the Bond Measure;
2) Develop taxpayer accountability protections to be included in the ballot measure;
3) Work with legal counsel to develop a resolution calling for the election;
4) Work with legal counsel to develop the 75-word ballot question;
5) Work with legal counsel to develop and refine the full text of the measure, project list, tax rate statement and other materials that will appear in the ballot pamphlet mailed to all voters;
6) Present recommendations, documents and resolutions to the Board of Trustees for approval; and
7) Work with the County Registrar of Voters Office to assist Client in completing the process of qualifying for the ballot.
