Bank Discretion Sample Clauses

Bank Discretion. Except as the Customer may otherwise expressly instruct the Bank in writing prior to the opening of any Credit: (i) the Bank and/or any of its correspondents may receive and accept as "bills of lading" clean on board bill(s) of lading or document(s) issued, or purporting to be issued, by, or on behalf of, any carrier which acknowledge(s) receipt of goods for transportation, whatever the specific provisions of such document(s) and the date of such receipt. Any such bill of lading issued by, or on behalf of, an ocean carrier may be accepted by the Bank as an "ocean bill of lading" whether or not the entire transportation is by water; (ii) partial shipment(s) and/or shipment(s) in excess of the quantity called for in the Credit may be made and the Bank may honor the relative drafts; provided, that the liability of the Customer to reimburse the Bank for payments made, or obligations incurred, on such drafts shall be limited to the amount of the Credit; (iii) if the Credit specifies shipments in installments within stated periods, and the shipper fails to ship in any designated period, the Bank may, at its option, refuse to honor drafts relating to the installment so failed and/or any installment(s) subsequent thereto, even though the shipment of such subsequent installment(s) may be made in the designated period(s); (iv) the Bank and/or any of its correspondents may receive and accept as documents of insurance either insurance policies or insurance certificates which need not be for an amount of insurance greater than the amount paid by the Bank pursuant to the Credit; and (v) the Bank and/or any of the Bank's correspondents may receive, accept or pay as complying with the terms of the Credit, any draft or other documents, otherwise in order, which may be drawn, or issued by, an administrator, executor, trustee or receiver of the party in whose name the Credit provides that any drafts or other documents should be drawn or issued.

Bank Discretion. The Bank may, in its discretion, refuse a deposit to a Business Account, or refuse to process any Instruction or Document from the Customer, for any reason in accordance with its policies, procedures, or guidelines, including if the Document exceeds processing volumes established by the Bank.
Bank Discretion. (a) Issuer may assume that any beneficiary or other presenter acts in good faith and that any presentation or other demand is nonfraudulent.
