Common use of Bargaining Agent Recognition Clause in Contracts

Bargaining Agent Recognition. (a) The Employer recognizes the Council as the exclusive Bargaining Agent of the Employees in the bargaining unit for the purposes of sections 33 to 37, subsections 38(1) and (2) and sections 39, 40, 47 to 52 and 61 to 75 of the Trade Union Act, as amended. (b) The Employer recognizes the Union as the exclusive bargaining agent on behalf of all Employees of the Employer who occupy positions in the bargaining unit described in paragraph (a) for which the Union was certified or voluntarily recognized as bargaining agent before April 1, 2015 for all purposes other than those listed in paragraph (a).
