Bargaining Over Mandatory Subjects. 3.5.1 Except as provided in this Agreement or by applicable law, the University will satisfy its collective bargaining obligation before changing a matter that is a mandatory subject. The University will notify the Executive Director of the Union, with a copy to the Chief Union Xxxxxxx, of the proposed changes and the Union may request discussions about and/or negotiations on the impact of these changes on employee’s working conditions. In the event the Union does not request discussions and/or negotiations within fourteen (14) calendar days, the University may implement the changes without further discussions and/or negotiations; provided that the Union may request an extension of the timeline in this section which will not be unreasonably denied. There may be emergency or mandated conditions that are outside of the University’s control requiring immediate implementation, in which case the University will notify the Union as soon as possible.

Bargaining Over Mandatory Subjects. Except as permitted in this Agreement or by applicable law, the City will satisfy its collective bargaining obligation before changing a matter that is a mandatory subject. The City will provide written notice (by letter and/or e-mail) of the proposed changes to the Union Representative or designee, and the Union will have fourteen (14) calendar days from the date of the notice to demand to bargain the change or impact of the change, as appropriate. Union demands to bargain must be submitted in writing (by letter and/or e-mail) to the Senior Labor Relations Manager or designee. In the event the Union does not submit a timely demand to bargain, the City may implement the changes without further discussions and/or negotiations. There may be emergency or mandated conditions that are outside of the City’s control requiring immediate implementation, in which case the City will notify the Union as soon as possible.
Bargaining Over Mandatory Subjects. The Union recognizes the District's rights, but in no way relinquishes its rights to bargain collectively on any mandatory subject pertaining to wages, hours or conditions of employment in accordance with Oregon statutes.

  • Transfer and Seniority Outside Bargaining Unit No employee shall be transferred to a position outside the bargaining unit without his consent. If an employee is transferred to a position outside of the bargaining unit, he shall retain his seniority accumulated up to the date of leaving the unit, but will not accumulate any further seniority. If such an employee returns to the bargaining unit within twelve (12) months, he shall be placed in a job consistent with his seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.
