Capacity Augmentation of Project Highway. 30.1.1. The Contracting Authority may, notwithstanding anything to the contrary contained in this Agreement, require the capacity augmentation of the Project Highway in case the average daily traffic in any Accounting Year shall exceed the designed capacity for the Project Highway and shall continue to exceed the designed capacity for 3 (three)104 consecutive Accounting Years following thereafter ("Capacity Augmentation"). Any such Capacity Augmentation shall be made in accordance with the provisions of this Article 30. The Contracting Authority shall bear the costs towards required land acquisition, shifting of utilities/facilities as would be necessary for undertaking the Capacity Augmentation.

Capacity Augmentation of Project Highway. The Authority may, notwithstanding anything to the contrary contained in this Agreement, require the Capacity Augmentation for any homogenous/ tollable section(s)17 of the Project Highway in case the average daily traffic of PCUs for that homogenous/tollable section(s), in any Accounting Year shall exceed the designed capacity Target Traffic18 for Project Highway and shall continue to exceed the designed capacity for 3 (three) consecutive Accounting Years following thereafter. Any such Capacity Augmentation shall be made in accordance with the provisions of this Article 14. The Authority shall bear the costs towards required land acquisition, shifting of utilities/ facilities as would be necessary for undertaking the Capacity Augmentation. In the event, at any time during the Concession Period the average daily traffic increases beyond Target Traffic, the Authority may, decide to cause preparation of a Detailed Project Report (DPR). The said DPR, inter-alia will assess the cost as may have to be incurred for augmenting the capacity of the homogenous/tollable section(s) of the Project Highway in accordance with the provisions of the Indian Roads Congress publication or any substitute thereof. In case the Authority determines that Capacity Augmentation is reasonably required by reason of the then current traffic reaching the Target Traffic as aforesaid, then the Authority may undertake the required Capacity Augmentation, at its own cost and expense by engaging a EPC Contractor selected through competitive bidding process; provided however that the Concessionaire shall have the option of matching the first ranked bid, subject to the Concessionaire’s bid being within 10% (ten percent) of the first rank bid, and thereupon securing the award of EPC works contract, and the Concessionaire shall be eligible to exercise such right/option, if Concessionaire participates in the said bidding process and fulfils the eligibility criteria to undertake such work without compromising with its overall liability. For avoidance of doubt, it is clarified that if the Concessionaire decides to participate in the competitive bidding it shall be required to demonstrate technical capability as set forth in the bidding documents either as a single entity or by forming a consortium with an EPC contractor; provided that in such a case, the technical capability of such EPC contractor shall only be considered for the purpose of evaluation.   • Interconnection Facilities Engineering Procurement and Construction Interconnection Facilities, Network Upgrades, and Distribution Upgrades shall be studied, designed, and constructed pursuant to Good Utility Practice. Such studies, design and construction shall be based on the assumed accuracy and completeness of all technical information received by the Participating TO and the CAISO from the Interconnection Customer associated with interconnecting the Large Generating Facility.

  • Completion of Project The Borrower shall carry out the Project in accordance with the Technical Description as may be modified from time to time with the approval of the Bank, and complete it by the final date specified therein.

  • System Upgrade Facilities and System Deliverability Upgrades Connecting Transmission Owner shall design, procure, construct, install, and own the System Upgrade Facilities and System Deliverability Upgrades described in Appendix A hereto. The responsibility of the Developer for costs related to System Upgrade Facilities and System Deliverability Upgrades shall be determined in accordance with the provisions of Attachment S to the NYISO OATT.

  • Construction of Project 11.1.1 Developer agrees to cause the Project to be developed, constructed, and installed in accordance with the terms hereof and the Construction Provisions set forth in Exhibit D, including those things reasonably inferred from the Contract Documents as being within the scope of the Project and necessary to produce the stated result even though no mention is made in the Contract Documents.

  • Preconstruction Phase Services Preconstruction Phase Services shall mean all services described in Article 3.1, and any similar services described in the Request for Proposals, including such similar services as are described in the Construction Manager at Risk’s Response to the Request for Proposals to the extent they are accepted by Owner, but excluding any Early Work. Early Work shall be considered part of Construction Phase Services.

  • Building Commissioning Services The Owner may provide as a part of its testing services the Building Commissioning services involving the project’s HVAC and exhaust systems, temperature control systems, fire detection and alarm systems, emergency power and lighting system, fire suppression system, security locks and security locking control systems, food service equipment (if applicable), and laundry equipment (if applicable). In the event the Using Agency’s Program specifies additional commissioning services, the Owner shall procure such services as well. The Owner, through its Executive Administrator, may engage an independent Commissioning Authority. It is the intent of this Article that the Commissioning Authority enforce the requirements mentioned herein and certify that the systems and equipment listed all function properly prior to the initiation of each final inspection.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment. The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract.

  • Interconnection Customer’s Interconnection Facilities Construction The Interconnection Customer’s Interconnection Facilities shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Participating TO and Interconnection Customer agree on another mutually acceptable deadline, the Interconnection Customer shall deliver to the Participating TO and CAISO “as-built” drawings, information and documents for the Interconnection Customer’s Interconnection Facilities and the Electric Generating Unit(s), such as: a one-line diagram, a site plan showing the Large Generating Facility and the Interconnection Customer’s Interconnection Facilities, plan and elevation drawings showing the layout of the Interconnection Customer’s Interconnection Facilities, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer's step-up transformers, the facilities connecting the Large Generating Facility to the step-up transformers and the Interconnection Customer’s Interconnection Facilities, and the impedances (determined by factory tests) for the associated step-up transformers and the Electric Generating Units. The Interconnection Customer shall provide the Participating TO and the CAISO specifications for the excitation system, automatic voltage regulator, Large Generating Facility control and protection settings, transformer tap settings, and communications, if applicable. Any deviations from the relay settings, machine specifications, and other specifications originally submitted by the Interconnection Customer shall be assessed by the Participating TO and the CAISO pursuant to the appropriate provisions of this LGIA and the LGIP.
