Construction of Project. 11.1.1 Developer agrees to cause the Project to be developed, constructed, and installed in accordance with the terms hereof and the Construction Provisions set forth in Exhibit D, including those things reasonably inferred from the Contract Documents as being within the scope of the Project and necessary to produce the stated result even though no mention is made in the Contract Documents.
Construction of Project. 10.2.1. On receipt of the Letter of Commencement from the Authority and on and after the Commencement Date, the Concessionaire shall commence Construction Work for the Silo Complex as per the Construction Plan and in conformity with the Standards and Specifications and the Applicable Permits procured.
10.2.2. Within [30 (thirty) days] of receipt of Letter of Commencement, the Concessionaire shall submit the Designs and Drawings along with a construction plan specifying its construction methodology, procurement, engineering and construction plan, construction time schedule and quality assurance procedures (together “Construction Plan”) complying with the Standards and Specifications, capacities as per Schedule B and all Applicable Permits procured by it for carrying out the Construction Works related to the Silo Complex to the IE&A and the Authority. The IE&A and Authority shall complete their initial reviews of Construction Plan within [15 (fifteen) days] of the submission of the same by the Concessionaire. In the event the IE&A and/or the Authority seeks clarifications and/or suggests modification, if any, to the Construction Plan, the Concessionaire shall satisfy the IE&A and/or Authority on the issues raised, including making suitable modification in its Construction Plan as required.
10.2.3. The Concessionaire shall complete the Construction Works including the rail siding within the period between the Commencement Date and the Scheduled Commercial Operation Date.
10.2.4. The Concessionaire shall ensure that, by the end of the 12th (twelfth) month from the Commencement Date, that mid-term construction milestone (“Mid- Term Construction Milestone”) is achieved. The Mid-term Construction Milestone shall imply the achievement of all of the following:
(i) at least 33 % (thirty percent) by value of Total Project Cost has been expended;
(ii) masonry work relating to (a) base of {Long Term Storage Silos, pre- shipping silo / receiving silo} upto aeration floor level, (b) pit and foundation of process tower, (c) foundation of {pre-storage silo}, (d) dump pit construction are completed;
(iii) 90% of boundary wall has been completed; and
(iv) major components for Long Term Storage Silos, {pre-storage silo, pre- shipping silo, receiving silo} are procured and available at Site. The components mentioned herein shall be as specified in Schedule B. The Concessionaire shall, within 15 (fifteen) days from the end of 12th (twelfth) month from Commencement Date, submit ...
Construction of Project. Purchaser shall (i) perform the Final Assembly Work which is set forth in Exhibit P hereto, (ii) perform all civil works (including roads, grading, maintenance facilities, meteorological towers and other items); (iii) perform all electrical works (including collection lines, Electrical Infrastructure, Transmission Facilities, Interconnection Facilities and other items); (iv) provide and install a remote terminal unit and cabling to the Substation, meteorological towers, and communications lines for the SCADA System to the Substation; and (v) provide any other items required for the operation of the Project; and
Construction of Project. As a further condition to the Lender’s funding of Project Costs pursuant to the terms of the MLA and this First Supplement, the Borrower will:
(i) diligently proceed with construction of the Project in accordance with the Plans and Specifications and in accordance with all applicable laws and ordinance and will complete the Project on or before the Completion Date;
(ii) use the proceeds of all Advances solely to pay the Project Costs as specified in the Project Sources and Uses Statement;
(iii) use its best efforts to require the Contractor(s) to comply with all rules, regulations, ordinances and laws relating to work on the Project;
(iv) obtain the Lender’s prior written approval of any change in the Plans and Specifications for the Project approved by the Lender which might materially adversely affect the value of the Lender’s security, and has a cost of $50,000.00 or greater. The Lender will have a reasonable time to evaluate any requests for its approval of any changes referred to in this paragraph. The Lender may approve or disapprove changes in its discretion, subject to the foregoing provisions of this Section 14(iv). If it reasonably appears to the Lender that any change may increase the Project Costs, the Lender may require the Borrower to deposit additional funds with the Lender pursuant to the provisions of this The MLA and this in an amount sufficient to cover the increased costs as a condition to giving its approval;
(v) comply with and keep in effect all necessary permits and approvals obtained from any Governmental Authority relating to the lawful construction of the Project. The Borrower will comply with all applicable existing and future laws, regulations, orders, and requirements of any Governmental Authority, judicial, or legal authorities having jurisdiction over the Real Property or Project, and with all recorded restrictions affecting the Real Property;
(vi) furnish to the Lender from time to time on request by the Lender, in a form acceptable to the Lender, correct lists of all contractors and subcontractors employed in connection with construction of the Project and true and correct copies of all executed contracts and subcontracts. Construction of Project. 12.1 Obligations prior to commencement of construction
12.1.1 Appoint its representative duly authorised to deal with Maha-Metro in respect of all matters under or arising out of or relating to this Agreement;
Construction of Project. 12.1. Project Site(s) Conditions and Contract Documents. Contractor acknowledges that it has and will perform certain special services in preparation to construct the Project.
Construction of Project. The Entity, in conjunction with the District, agrees to cause the Project to be developed, constructed, and installed in accordance with the terms hereof, the General Construction Terms and Conditions set forth in Exhibit D, the Plans and Specifications and those things reasonably inferable from the aforementioned documents as being within the scope of the Project and necessary to produce the stated result even though no mention is made thereof. The Entity, in conjunction with the District, further agrees that it will cause the development, construction, and installation of the Project to be diligently performed. The parties may approve additional changes in the Plans and Specifications for the Project as provided in Exhibit D.
Construction of Project. Contractor agrees to cause the Project to be diligently developed, constructed, and installed in accordance with the express provisions of the Contract Documents, including those things reasonably inferable from the Plans and Specifications as being within the scope of the Project and necessary to produce the stated result. Contractor shall time construction of the Project to commence within five (5) days after receiving the District’s Notice to Proceed. Contractor shall provide District a complete copy of the executed construction contract documents consistent with the General Conditions and the Plans and Specifications. District and Contractor may also approve additional changes in the Work for the Project as provided in the Contract Documents. District and Contractor will cooperate at all times in bringing about the timely completion of the Project. Contractor shall cooperate with District's efforts to obtain State funding for the Project by complying with any State requirements as reasonably requested by District, including, without limitation sections 1859.104 to 1859.106 of Title 2 of the California Code of Regulations.

After the District’s issuance of a Notice to Proceed, Contractor agrees to cause the Project to be developed, constructed, and installed in accordance with the terms hereof and the Construction Provisions set forth in Exhibit D, including those things reasonably inferable in the Construction Provisions as being within the scope of the Project and necessary to produce the stated result even though no mention is made in the Construction Documents.
Construction of Project. Proceed diligently and without interruption (EXCEPT as may be caused by events outside the control of Borrower) to construct and furnish the Project in accordance in all material respects with the Construction Plans, the Construction Budget and the Construction Timetable, and in any event cause the Completion Date to occur not later than December 31, 1997.
