The Cause Dismissal clause defines the conditions under which an employee may be terminated immediately due to specific misconduct or failure to meet essential obligations. Typically, this clause outlines actions such as theft, fraud, gross negligence, or violation of company policies that justify dismissal without notice or severance. Its core function is to protect the employer by providing a clear legal basis for ending employment in cases of serious wrongdoing, thereby minimizing risk and ensuring workplace standards are upheld.
CAUSE DISMISSAL. If the Superintendent/designee determines that it is necessary to dismiss the first year employee mid-year, for cause, the employee may request a hearing, as provided in the California Education Code, and the decision of that hearing shall constitute a recommendation to the Board of Trustees and shall be advisory only.
CAUSE DISMISSAL. 12-1 In the event the Board finds that probable cause exists for charges to be brought against a tenured employee pursuant to Education Law, Section 3020A, the employee may elect to waive the statutory procedures under Section 3020A and elect the grievance procedure.
12-2 The staff member shall notify the Superintendent in writing of his/her choice of procedure within 10 days of the receipt of the statement of charges.
12-3 Failure of the staff member to notify the Superintendent of his/her choice of procedures within the specified time period shall be deemed a waiver of rights to pursue either procedure.
CAUSE DISMISSAL. Mid-year dismissals for cause shall be as provided in section 10.1.1.2 above for first year probationary employees.
CAUSE DISMISSAL. 14. 1 No adjunct, who has completed the initial appointment period, shall be dismissed by the College without all rights prescribed below.
14. 2 Dismissal of an employee shall be for just cause; shall be subject to the grievance procedure provided herein, and may be initiated at Stage 3 within ten (10) work days of the receipt of written notice of dismissal.
