CEAP/EAP Referral Sample Clauses

The CEAP/EAP Referral clause establishes the process by which employees may be directed or encouraged to utilize a company's Counseling or Employee Assistance Program (EAP) services. Typically, this clause outlines the circumstances under which management can refer an employee to the EAP, such as when job performance issues or personal problems are observed, and may specify whether participation is voluntary or mandatory. Its core function is to provide a structured mechanism for supporting employee well-being and addressing workplace issues proactively, thereby helping to resolve problems before they escalate and maintaining a productive work environment.
CEAP/EAP Referral a. Employees who receive a first confirmed positive test result, or who voluntarily admit illegal drug use under Section 7, will be referred to the CEAP/EAP consistent with applicable laws and regulations. However, such referral shall not be construed as a precondition or Safe Harbor to imposition of discipline and/or adverse action on the employee for use or possession of illegal drugs. Referrals to CEAP/EAP are separate and apart from the employee disciplinary process for all purposes. b. When it appears CEAP/EAP referral is appropriate, the Local Union will encourage the employee to respond positively to the referral. c. Because of its special relationship with bargaining unit members, the Local Union will guide, support, represent, and otherwise influence an employee to affect the most positive outcome possible.
