City Project Costs Funding Commitment and Funding Sources. The City shall use its reasonable and best efforts to obtain funds from the issuance, sale, and delivery of one or more series of Arena Complex Bonds in an amount that is net after providing for the payment of issuance costs, the creation of reserves, and the deposit of capitalized interest, and upon terms and conditions that conform to applicable law, and that are satisfactory to the City, equal to $225,000,000 less the Prior Public Contribution Amount (not including delayed bond issuance, if any, as permitted by Section 2.7(d) of the Master Agreement).

City Project Costs Funding Commitment and Funding Sources. (a) The City shall use its reasonable and best efforts to obtain funds from the issuance, sale, and delivery of one or more series of Special Tax Revenue Bonds (on a taxable or tax-exempt basis) in an aggregate amount that is net (after providing for the payment of issuance costs, the creation of reserves, and the deposit of capitalized interest, if any, and upon terms and conditions that conform to Applicable Law, and that are satisfactory to the City) sufficient to fund the full amount of the City Contribution.

  • STAFF COMMITMENT 23. If this Settlement Agreement is accepted by the Hearing Panel, Staff will not initiate any proceeding under the By-laws of the MFDA against the Respondent in respect of the facts set out in Part IV and the contraventions described in Part V of this Settlement Agreement, subject to the provisions of Part IX below. Nothing in this Settlement Agreement precludes Staff from investigating or initiating proceedings in respect of any facts and contraventions that are not set out in Parts IV and V of this Settlement Agreement or in respect of conduct that occurred outside the specified date ranges of the facts and contraventions set out in Parts IV and V, whether known or unknown at the time of settlement.
