Civil Service Protection for Employees in Bargaining Unit. The Agency and the Union agree that, as of the date of this Agreement, all members of the Bargaining Unit are employees covered by the Merit System Principles of the Civil Service or by Schedule A of the excepted service; have been hired by a neutral, merit-based selection process; and are not subject to employment-at-will. As of the date of this Agreement, all members of the Bargaining Unit are entitled to the protections of the Civil Service Reform Act of 1978 and are not in confidential policy determining, policy-making, or policy-advocating positions that are subject to change as a result of Presidential transition.
