Class Notice Forms a. Exhibit D constitutes a list of the members of the LaSalle Settlement Class to whom notice pursuant to this Agreement shall be provided. Prior to mailing, Plaintiffs’ Counsel will update the addresses by use of the United States Postal Service’s National Change of Address database or another address database service (e.g., Accurint, Intelius, TLO). Plaintiffs’ Counsel will re-mail any returned notices to any new address disclosed. To the extent any notice is returned a second time, Plaintiffs’ Counsel shall undertake reasonable efforts to locate current addresses for said class member(s). The notices shall be mailed within five (5) days of the Preliminary Approval Order.

Class Notice Forms a. Exhibit C constitutes a list of the members of the Settlement Class to whom notice under the Agreement shall be provided. Prior to mailing the Class Mail Notices, the Settlement Administrator will update the addresses by the United States Postal Service’s National Change of Address database or another address database service (e.g., Accurint, Intelius). The Settlement Administrator will re-mail any returned notices to any new address disclosed. If any notice is returned a second time, the Settlement Administrator shall undertake reasonable efforts to locate a current address for the Settlement Class Members. The portion of the Net Distributable Settlement Fund attributable to where the Settlement Administrator is unable to obtain a current address shall remain a part of the Net Distributable Settlement Fund and will be reallocated to the Settlement Class Members with valid current addresses pro rata. The notices shall be mailed within ten (10) business days after the Preliminary Approval Order. Also within ten (10) business days after the Preliminary Approval Order, the Settlement Administrator will provide the Court- approved Long-Form Notice and claim form on a website that the Settlement Class can access. If so requested by any member of the Settlement Class, the Settlement Administrator shall also mail a copy of the Long-Form Notice to the requesting member by first-class mail.

Class Notice Forms a. Plaintiffs’ Counsel will provide a list of all potential Class Members to the Settlement Administrator. Prior to mailing, the Settlement Administrator (or one or more of its agents, employees or consultants) will update each address by comparing each address with the current address in the United States Postal Service’s National Change of Address database. If a Class Notice is returned, the Settlement Administrator shall re-mail such Class Notice if it is provided with a new address. If not, then the Settlement Administrator shall attempt to locate a new address for the returned mailing to re-mail such Notice by consulting with the Transunion Address database. Neither the Bank nor the Settlement Administrator shall have any further obligations to attempt to locate Class Members or send Class Notices to potential members of the Plaintiff Class. Neither the Parties nor their representatives shall otherwise use the list, the data the DHSMV provided to the Bank between May 1, 2000 and September 30, 2003, or the data obtained from DHSMV during discovery in the Litigation to initiate any further communication with the Plaintiff Class or any Class Member.

  • Notice of Elections To make an election pursuant to this Section, the Borrower shall notify the Administrative Agent of such election by telephone by the time that a Borrowing Request would be required under Section 2.03 if the Borrower were requesting a Borrowing of the Type resulting from such election to be made on the effective date of such election. Each such telephonic Interest Election Request shall be irrevocable and shall be confirmed promptly by hand delivery or telecopy to the Administrative Agent of a written Interest Election Request in a form approved by the Administrative Agent and signed by the Borrower.
