COMMENCEMENT, DURATION AND CONNECTION. This BCA shall take effect on the date hereof and shall continue in force until terminated in accordance with Clause 7. The DCUSA and this BCA shall supersede any prior agreements or arrangements between the Company and the User in respect of Connection at the Connection Point(s) specified herein. THE USER’S RIGHT TO BE AND TO REMAIN CONNECTED TO THE COMPANY’S DISTRIBUTION SYSTEM Subject to the terms and conditions of the DCUSA and this BCA, the User shall, from the Commencement Date have the right for the User’s Distribution System to be, and to remain, Connected to the Company’s Distribution System at the Connection Point(s) specified herein, and (subject to the DCUSA and this BCA) the right to be and remain Energised. The rights referred to in Clause 3.1 are conditional upon: - completion of the relevant Connection Equipment and Connection Assets under and in accordance with any agreement for the construction or modification of the Connection Equipment and Connection Assets so that they may be Energised; the Company having procured, or the User having procured or granted to the Company in respect of land owned, leased, operated or under its control, the Land Rights and interests for the Connection Equipment and Connection Assets as specified in Schedule 1 (and those land rights and interests remaining in force); any Land Rights granted to the User by the Company or any Affiliate of the Company remaining in full force and effect; the Land Rights permitting use of, alteration of, and /or sub-letting of the Company’s Premises for the connection of the User’s Distribution System to the Company’s Distribution System and any related third party consent remaining in full force and effect; and any other third party consent required having been granted unconditionally; and the Company shall be entitled at any time to, lawfully and without cost to it: - to occupy the premises upon which the Connection Assets and Connection Equipment is placed; and to exercise the Land Rights granted to it, in relation to the land upon which the Connection Assets and Connection Equipment are situated, as detailed in Schedule 1, and upon the termination of the rights created thereby for so long thereafter upon the same terms as are contained in those Land Rights as Connection of the User’s Installation to the Distribution System may be required and lawfully continued. COMMENCEMENT, DURATION AND CONNECTION. 2.1 Subject to Clause 3.2 this Agreement will commence on the Commencement Date and will continue in force until terminated in accordance with Clause 17. 2.2 From the Commencement Date, the Company shall provide and the User shall be entitled to use the Distribution System only insofar as necessary for the transport of electricity to or from the Connection Points listed in Section 3 of the First Schedule. 2.3 This Agreement shall govern the terms upon which 2.3.1 each Connection Point to the User’s Distribution Network listed in Section 3 of the First Schedule shall be connected and be entitled to remain connected to the Distribution System; and 2.3.2 the Company shall distribute electricity through the Connection Point with effect from the Commencement Date, and this Agreement shall supersede any prior agreements or arrangements between the Company and the User in respect of the Connection Point and the User’s Distribution Network.

  • Commencement and Completion 3.1 The Owner agrees to commence the Restoration Works, Landscaping Works, and Servicing Works forthwith upon adoption of City of Kelowna Heritage Revitalization Agreement Authorization Bylaw No. and to complete the Works no later than August 1, 2006.

  • Commencement of Work Engineer shall not commence any field work under this Contract until he/she/it has obtained all required insurance and such insurance has been approved by County. As further set out below, Engineer shall not allow any subcontractor/subconsultant(s) to commence work to be performed in connection with this Contract until all required insurance has been obtained and approved and such approval shall not be unreasonably withheld. Approval of the insurance by County shall not relieve or decrease the liability of Engineer hereunder.

  • Commencement of Negotiations Within five (5) days of satisfaction of the public notice requirement, and not later than forty-five (45) days following submission of the proposal, negotiations shall commence at a mutually acceptable time and place for the purpose of considering changes in this Agreement.

If project commencement is delayed, the Grantee must submit in writing to the assigned contract manager, the steps taken to initiate the project, the reasons for the delay, and the expected start date. System Agency may require Grantee to take immediate remedial or corrective action in response to any delay.

  • Commencement of Services The Services will be commenced immediately upon receipt of the signed Proposal (the “Agreement”). If after commencement of the Services, the Project is delayed for any reason beyond Xxxxxxxxx’x control for more than 60 days, the terms and conditions contained herein will be subject to revision by Xxxxxxxxx. Subsequent modifications to this Agreement must be in writing and signed by the parties to the Agreement.

  • Commencement and Completion of Work The professional services to be performed pursuant to this Agreement shall commence within five (5) days from the Effective Date of this Agreement. Failure to commence work in a timely manner and/or diligently pursue work to completion may be grounds for termination of this Agreement.
