COMMITMENT TO BARGAINING. Employees employed by the Employer in the classifications contained within this Agreement will not be employed under any form of individual agreement made pursuant to the Fair Work Act 2009 (Cth) or the Industrial Relations Act 1979 (WA), as amended or superseded from time to time.

Employees engaged to work in classifications covered under the Award or the Federal Agreement will not be employed under any form of individual contract or agreement made pursuant to the Workplace Relations Xxx 0000, or the Industrial Relations Xxx 0000, as amended or superseded from time to time.

The parties agree to bargain in good faith all matters pertaining to wages, hours, terms and other conditions of employment, and the continuation, modification or deletion of any existing provision of this Agreement, and other mutually agreed subjects. This bargaining obligation does not compel either party to agree to a proposal or to make a concession.

The Board and the Association have endorsed the practices and procedures of collective bargaining as a fair and orderly way of conducting relations between the Board and the ESP employees represented by the Association, insofar as such practices and procedures are appropriate to the obligations of the Board to retain the right to effectively operate Rock Valley College and are consonant with the paramount interest of the public and the students of Rock Valley College.

Scope of Negotiations - The Nelsonville-York Board of Education shall enter into negotiations with OAPSE Local #400 for the purpose of achieving a signed master agreement covering all matters pertaining to or affecting wages, hours, and terms and conditions of employment of each employee represented by the bargaining unit.
