Company Contract. Company Contract. “Company Contract” shall mean any Contract: (a) to which any of the Acquired Corporations is a party; (b) by which any of the Acquired Corporations or any asset of any of the Acquired Corporations is bound or may, on the basis of an executory obligation as of the date of this Agreement or entered into by the Company as permitted hereunder, become bound in the future, or under which any of the Acquired Corporations has, or may, on the basis of an executory obligation as of the date of this Agreement or entered into by the Company as permitted hereunder, be subject to any obligation; or (c) under which any of the Acquired Corporations has or may, on the basis of an obligation executory as of the date of this Agreement or entered into by the Company as permitted hereunder, acquire any right or interest.

COMPANY NAME AND LEGAL FORM The company name is the Financial Investment Company Oltenia SA, the company logo (abbreviated name) is SIF Oltenia SA and the emblem is with the model attached. The legal form of the company is that of stock company and is classified under "other collective investment bodies" (AOPC) respectively a type closed investment company as defined by Law no. 297/2004 on the capital market. The company develops its activity in accordance with Romanian legislation, Law No. 297/2004 on the capital market, Law 31/1990 on commercial companies with subsequent modifications, and in accordance with the provisions contained in its constituent documents. The company is the successor of FPP V Oltenia, rearranged and transformed in accordance with Law no. 133/1996. The company is self-managed. The Board of Directors may decide to change the way of management and may conclude a management contract with a management company licensed by the CNVM, under the laws.
