Responsibilities of the Design Professional. The Design Professional of Record is authorized to act on the Design Professional’s behalf with respect to the Project, however, he is not a representative or agent of the Owner and has no authority to act on behalf of the Owner except as stated in the General Conditions of the construction contract. • No reports, information or other material given to or prepared by the Design Professional under this Contract shall be made available to any person not directly or indirectly involved with the construction or design of the Project without the prior written approval of the Owner unless otherwise required by law. • To comply with all applicable laws, codes, and regulations in effect at the time the Construction Documents are completed. • To make reasonable efforts to obtain written approval of the appropriate authority of all proposed connections to private or public utility systems or public and private roads and streets, and to design such connections planned as part of the Project. • To design all connections to public roads and streets as required by applicable ordinances and codes. • To receive no fee for Change Orders caused by failure to comply with the obligations in this Contract. • To ask the owner for additional time, if he is unable to meet a specified time period. • To provide Construction Documents that conform to applicable building codes, zoning codes, laws, regulations and generally accepted construction industry standards.
