Common use of Conditional Appointment Clause in Contracts

Conditional Appointment. (a) Notwithstanding Article 11.01, where the Employer deems it necessary to recruit employees from within the bargaining unit who do not meet the qualifications of the position but are currently enrolled in a program leading to meeting the qualifications in a reasonable time period as determined by the Employer, such employees may be appointed with the condition that the employee obtain the required qualifications in an agreed time period. Failure of the employee to achieve the required qualifications within the agreed time period or any mutually agreed extension to such time period will result in the employee being returned to their former position or to an equivalent position where their former position is not available.
