Consistency with Commission Regulations. The project authorized by this letter of agreement involves an experiment that includes the placement of up to 25 piling jackets over existing creosote-treated pilings and testing different surface treatments to evaluate the habitat benefits or enhancements from different types of materials. Each jacket and surface treatment would be no more than 5 centimeters thick and vary in height between 3-6 meters depending upon the length of each existing piling. The jackets themselves are pvc or other commercially available material that will be secured using stainless steel screws at the top and bottom of the piling and sealed with marine- grade, non-toxic epoxy. The surface treatments will each be tested on a total of five pilings and the treatments include: (a) jacket only with smooth surface, (b) jacket only with rough surface, (c) jacket plus stainless steel mesh, (d) jacket plus aluminum mesh, and (e) jacket plus carbon-fiber grid. The experimental study authorized by this letter of agreement has been incorporated under the Cosco Busan Oil Spill Final Damage Assessment and Restoration Plan/Environmental Assessment (DARP/EA) approved in February 2012. This experiment is important to the Bay Region to test the efficacy of different materials that would repurpose existing creosote-treated piles not slated for removal as subtidal habitat. The USGS plans to place the initial experimental setup in Fall 2020 and monitor all treatments for a period of one year to identify if any of the treatments provide significantly better habitat than other treatments. USGS may decide after the first year to remove treatments that are under performing and replace them with the treatments providing better habitat benefits. The experiment would be monitored for a total of three years after installation. Following the expiration of this letter of agreement, the USGS will be leaving the jackets in place to continue encapsulating the creosote-treated pilings and improve Bay water quality. The project authorized by this letter of agreement is consistent with the XxXxxxx-Xxxxxx Act and with the San Francisco Bay Plan in that it will not adversely affect the Bay nor public access to and enjoyment of the Bay. The USGS anticipates short-term, temporary increases in water turbidity during installation of the jackets, but that these impacts will dissipate quickly after the installation of the jackets/treatments.
