Construction and Design. The City will design and construct the Community Center. The City and Library will jointly design and construct the Library Branch portion of the Project and the Library will have input on Common Amenities, as set forth in a separate Intergovernmental Agreement between the Library and the City described in Section III below. The City will consult with the School District, but will have final decision-making authority, on site planning for the Community Center, and on the designs for the Aquatics Facility at the 50% design stage.
Construction and Design. Parties agree that the Project shall be constructed according to the design and concept provided by CRC in attached Exhibit A, which includes entry plaza, security wall and storage bins, iron and gabion fencing, and educational material and tool storage.
Construction and Design. (1) Acquisition of property interests. As of this Amendment, Greeley and North Weld have not finalized the acquisition of all property interests necessary to construct, operate, maintain, repair, replace, and remove the Harmony Interconnect, including the ▇▇▇▇▇ Ranch Water Line Easement. ▇▇▇▇▇▇▇ will diligently pursue and be responsible for acquiring the ▇▇▇▇▇ Ranch Water Line Easement . Once ▇▇▇▇▇▇▇ has acquired the necessary property interests in the ▇▇▇▇▇ Ranch Water Line Easement, Greeley and North Weld will enter into a separate agreement to the extent necessary granting North Weld the right to use those property interests for the purpose of locating, installing, constructing, operating, repairing, replacing, and removing any permanent infrastructure and facilities within that area in accordance with this Amendment. ▇▇▇▇▇▇▇ will also convey through a bill of sale the infrastructure that has been constructed within the ▇▇▇▇▇ Ranch Water Line Easement for North Weld’s use. In exchange for granting North Weld use of those property interests, North Weld shall pay Greeley its pro rata share of the fair market value of the property interests acquired by Greeley on its behalf, which pro rata share will be equal to 50% of the value of the area of the ▇▇▇▇▇ Ranch Water Line Easement between the point of connection and Greeley’s connection gate valve.
Construction and Design. Encasements intended to contain caskets shall be constructed, at a minimum, of cement and shall be capable of supporting a minimum load of eighteen (18) inches of dirt.

The Company acknowledges the critical nature of the municipal services performed or provided by the City to the Residents that require the Company to provide prompt and reliable Utility Service and the performance of related services for City facilities. The City and the Company wish to provide for certain terms and conditions under which the Company will provide Utility Service and perform related services for the City in order to facilitate and enhance the operation of City facilities. They also wish to provide for other processes and procedures related to the provision of Utility Service to the City.
