PM officially closes project with Real Estate SITE SURVEY Prior to the commencement of any installation, a certified installation team will conduct a site survey at the designated installation location(s). This team will be designated by WinStar NC&D and will be comprised of contractors, WinStar personnel, or a combination of both. The Site Survey Team will comply with the procedures described below. The Site Survey Team should always work in cooperation with the building engineer/manager while performing the site survey. These guidelines generally apply to rooftop installation or towers.

Construction Complete. Fifty (50) percent of the total credits that meet the performance standards will be approved after the MDEQ determines that construction has been completed in accordance with plans and specifications included in this Agreement and appendices and design hydrology has been achieved and maintained for at least 1 calendar year, based on the following performance standards being met:

2. The wetland is designed to have certain hydrological characteristics, such as water elevation, water depth, water level fluctuations, and frequency and duration of inundation, consistent with the ecological wetland types proposed as set forth in the site drawings. The MDEQ will consider design hydrology to be established when it determines that the following conditions are met for at least 1 calendar year, based on monitoring of the Bank: Forested, scrub-shrub, and wet meadow wetlands shall be consecutively saturated within 12 inches of the soil surface for at least 15 percent of the growing season. For purposes of assigning credits for construction complete, forested and scrub-shrub wetlands shall not be deeper than 2 inches above the surface for more than 30 percent of the growing season. Emergent wetlands shall be consecutively saturated within 12 inches of the soil surface for at least 30 percent of the growing season. Water depth in the emergent wetland shall not exceed 18 inches above the surface for the purposes of approving credits for construction complete, except that no more 15 percent of the emergent wetland may have water depths greater than 18 inches. Construction Complete. Landlord and Tenant hereby agree that construction of the Building was substantially completed in accordance with the terms of the Lease, that Tenant has fully accepted the Building and the Premises, and that Landlord has no further duty or obligation under the terms and provisions of the Lease with respect to the construction, equipping or delivery to Tenant of the Building or the Premises.

Notwithstanding the foregoing, in the event that Work with respect to a Site that Company deems not to be material to the achievement of the Construction Complete Milestone cannot reasonably be completed due to circumstances beyond the reasonable control of Contractor, such as painting or landscaping when weather conditions do not permit, the Parties will agree on a completion date for the incomplete items which is reasonable under the circumstances, and the Work at such Site will for all other purposes be deemed complete. If, within seven (7) Business Days after Company’s receipt of the Construction Complete Notice To Company, Company does not notify Contractor of any deficiency in the Work or Deliverables or fails to acknowledge its approval, then the Construction Complete Milestone will be deemed complete and accepted by Company. With respect to any data listed by Company as incomplete or Work or Deliverable requiring correction or resubmission, Contractor will complete such activity and the above acceptance procedure will be repeated.
