Survey Team. (a) As soon as possible after the Survey Agreement Date, and where either the RC or the Proponent is contracting the Aboriginal Heritage Service Provider, the Aboriginal Heritage Service Provider, in conjunction with the Principal Aboriginal Heritage Consultant if appointed, after receiving names and contact details of the Aboriginal Consultants from the RC in accordance with 8.3(d)(vii), will organise a Survey Team (Survey Team), which shall consist of: (i) up to 8 Aboriginal Consultants, with appropriate experience and authority, as are necessary, in the opinion of the Aboriginal Heritage Service Provider in consultation with the RC, to examine the Survey Area and assist in the Survey; and (ii) if considered necessary by the Aboriginal Heritage Service Provider and agreed to by the Parties, an Aboriginal Heritage Liaison Officer, who will be responsible for Survey logistics and on-ground operations; and (iii) where considered necessary by the Aboriginal Heritage Consultants, the RC or the Aboriginal Heritage Service Provider, and agreed to by the Parties, another anthropologist of a specific gender; and (iv) where the Survey being conducted is a Site Identification Survey, or where considered necessary by the Aboriginal Heritage Service Provider and agreed to by the Parties, including during the course of the Survey, an archaeologist. (b) Where considered necessary by the Aboriginal Heritage Service Provider and agreed to by the RC and the Proponent, more than one archaeologist may be appointed to the Survey Team. (c) The number of paid Aboriginal Consultants to be appointed to the Survey Team will not be more than the number specified in clause 10.1(a)(i) unless particular circumstances can be demonstrated to exist including, for example: (i) a large number of registered Aboriginal Sites are known to exist within a Survey Area and the number of Aboriginal people who have authority to speak for those Aboriginal Sites and should be consulted about them is greater than 8; and/or (ii) the Survey Area crosses the boundaries of two or more RCs. In these circumstances the Proponent and the RCs must agree on the number of additional Aboriginal Consultants for the Survey Team. (d) Additional Aboriginal Consultants may accompany the Survey Team but the Proponent will not be liable for additional costs. Survey Team. (a) If a Survey is required to be conducted pursuant to clause 4, the Corporation, in consultation with the Native Title Party, must within 15 days of such decision appoint a Survey Team. (b) Unless otherwise agreed between the Parties, the Survey Team will comprise of the following: (i) an Anthropologist appointed by the Corporation, following agreement with the Native Title Party and the Grantee Party; (ii) in the case of either a Site Identification Survey or Site Avoidance Survey, a maximum of 6 Representatives. If the Anthropologist considers it appropriate that more than the prescribed maximum number of Representatives is required to ensure an effective and adequate survey, such additional number of Representatives shall be agreed upon by the Parties; (iii) upon advice of the Anthropologist and/or the Representatives, a duly qualified archaeologist appointed by the Corporation (who may or may not accompany the Survey Team); and (iv) at the discretion of the Corporation, any one officer in its employ. (c) The Grantee Party may appoint a representative(s) to act as an observer during visits to the Survey Area who must abide with directions issued by the Survey Team to allow the Survey Team to deliberate on matters in private. (d) The Native Title Party agree to promptly replace any member of the Survey Team if necessary, including if it is established that the person is not acting in good faith in carrying out his or her duties in the course of the Survey.
Survey Team. (a) As soon as possible after the Survey Agreement Date, the Native Title Group or the Native Title Group’s nominated Aboriginal Heritage Service Provider, in conjunction with the Principal Aboriginal Heritage Consultant (if appointed), will organise a Survey Team, which shall consist of: (i) up to 6 Aboriginal Consultants, unless the Survey Area is outside of the Determination Area, in which case, the Survey Team will include up to 6 individuals who are either Aboriginal Consultants or Other Aboriginal Consultants, with appropriate experience and authority, as are necessary, in the opinion of the Aboriginal Heritage Service Provider or Principal Aboriginal Heritage Consultant (as the case may be), to examine the Survey Area and assist in the Survey; and (ii) if considered necessary by the Native Title Group and supported by the Aboriginal Heritage Service Provider or Principal Aboriginal Heritage Consultant (as the case may be) and agreed to by the Government Proponent, an Aboriginal Heritage Liaison Officer, who will be responsible for Survey logistics and on‐ground operations; and
Survey Team. 9.1 The Practice may object to the inclusion of a member of the proposed survey team by lodging an objection in writing on the following grounds: a) The surveyor has been an employee of the Practice or the business entity through which the Practice is owned or operated within the three (3) year period prior to the proposed on-site assessment date; b) The surveyor has provided consulting services to the Practice or to the business entity through which the Practice is owned or operated within the three (3) year period prior to the proposed on-site assessment date; c) The surveyor has a connection or relationship with an employee of the Practice or the business entity through which the Practice is owned or operated; d) The surveyor has a pecuniary or other interest in the Practice that may affect the surveyor’s ability to conduct a proper and unbiased assessment; e) The surveyor has been the subject of a previous complaint made by the applicant Practice where the issues raised were found to be valid.
