Construction of this Instrument. Notwithstanding the use of the feminine, masculine or neuter gender with reference to any party in this Agreement, the same shall, in each instance, be construed to refer to the individual party. The captions and headings of various paragraphs of this Mortgage are for convenience only and are not to be construed as defining or limiting in any way, the scope or intent of the provisions hereof. This Mortgage and all provisions hereof shall extend to and be binding upon the Mortgagor and all parties claiming by, through or under the Mortgagor and the word "Mortgagor" when used herein shall include all persons liable for the payment of the indebtedness secured hereby or any part thereof, whether or not such persons shall have executed the Note or this Mortgage. The word "Mortgagee" when used herein shall include the successors and assigns of the Mortgagee named herein, and the holder or holders, from time to time, of the notes secured hereby.

  • Construction of Agreement The parties mutually acknowledge that they and their attorneys have participated in the preparation and negotiation of this Agreement. In cases of uncertainty this Agreement shall be construed without regard to which of the parties caused the uncertainty to exist.

  • Amendment of this Contract No provision of this Contract may be changed, waived, discharged or terminated orally, but only by an instrument in writing signed by the party against which enforcement of the change, waiver, discharge or termination is sought.
