Continuation of Lease Term. Lessee intends, subject to Section 3.03, to continue the Lease Term through the Original Term and all Renewal Terms. Lessee affirms that sufficient funds are available for the current fiscal year, and Lessee reasonably believes that an amount sufficient to make all Rental Payments during the entire Lease Term can be obtained from legally available funds of Lessee. Lessee further intends to do all things lawfully within its power to obtain and maintain funds sufficient and available to discharge its obligation to make Rental Payments due hereunder, including making provision for such payments to the extent necessary in each budget or appropriation request submitted and adopted in accordance with applicable provisions of law, to have such portion of the budget or appropriation request approved and to exhaust all available reviews and appeals in the event such portion of the budget or appropriation request is not approved.
Continuation of Lease Term. Lessee intends, subject to Section 3.03 hereof, to continue the Lease Term of each Lease through the Original Term and all Renewal Terms and to pay the Rental Payments due thereunder. Lessee affirms that sufficient funds are legally available for the current fiscal year, and Lessee reasonably believes that an amount sufficient to make all Rental Payments during the entire Lease Term of each Lease can be obtained from legally available funds of Lessee. Lessee further intends to do all things lawfully within its power to obtain and maintain funds sufficient and available to discharge its obligation to make Rental Payments due under each Lease, including making provision for such payments to the extent necessary in each budget or appropriation request submitted and adopted in accordance with applicable provisions of law. Notwithstanding the foregoing, the decision whether or not to budget and appropriate funds or to extend the Lease Term for any Renewal Term for each Lease is within the sole discretion of the governing body of Lessee.

Lessee affirms that sufficient funds are legally available for its current fiscal year to pay any Rental Payments when due during the current fiscal year, and Lessee reasonably believes that an amount sufficient to make all Rental Payments during the entire Lease Term of each Lease can be obtained from legally available funds of Lessee.
Continuation of Lease Term. Xxxxxx currently intends, subject to nonratification, to continue the Lease Term through the Original Term and all of the Renewal Terms and to pay the Rental Payments hereunder. Lessee reasonably believes that legally available funds in an amount sufficient to make all Payments during the Original Term and each of the Renewal Terms can be obtained. Notwithstanding the foregoing, the decision whether or not to budget or appropriate funds or to ratify this Agreement for any Renewal Term is solely within the discretion of the then current governing body of Lessee. New Unnumbered Section - Nonratification. Lessee is obligated only to pay such Rental Payments under this Agreement as may lawfully be made from funds budgeted and appropriated for that purpose during Xxxxxx's then current fiscal year. Should Lessee fail to ratify this Agreement for the Renewal Term following the then current Original Term or Renewal Term, this Agreement shall be deemed terminated at the end of the then current Original Term or Renewal Term. Xxxxxx agrees to deliver notice to Lessor of its ratification or termination of this Agreement at least ninety (90) days prior to the end of the then current Original Term or Renewal Term. Failure to give notice of such termination will not extend the Lease Term beyond such Original Term or Renewal Term. If this Agreement is terminated in accordance with this Section, Xxxxxx agrees, at Xxxxxx's cost and expense, to peaceably deliver the Equipment to Lessor at the location or locations to be specified by Lessor.

Lessee reasonably believes that legally available funds in an amount sufficient to make all Rental Payments during the maximum Lease Term of each Lease can be obtained. Lessee currently intends to do all things lawfully within its power to obtain and maintain funds from which the Rental Payments may be made, including making provision for such payments to the extent necessary in each budget or appropriation request submitted and adopted in accordance with applicable provisions of law. Notwithstanding the foregoing, the decision whether or not to budget and appropriate funds or to extend the applicable Schedule for any Renewal Term is within the discretion of the governing body of Xxxxxx.

Lessee currently intends, subject to the provisions of Section 3.05 and Section 4.04, to continue the Lease Term through the Original Term and all of the Renewal Terms and to pay the Rental Payments hereunder. Lessee reasonably believes that legally available funds in an amount sufficient to make all Rental Payments during the Original Term and each of the Renewal Terms can be obtained. The responsible financial officer of Lessee will do all things lawfully within his or her power to obtain and maintain funds from which the Rental Payments may be made, including making provision for such Rental Payments to the extent necessary in each proposed annual budget submitted for approval in accordance with applicable procedures of Lessee and to exhaust all available reviews and appeals in the event such portion of the budget is not approved. Notwithstanding the foregoing, the decision whether or not to budget or appropriate funds or to extend this Agreement for any Renewal Term is solely within the discretion of the then current governing body of Lessee.

Lessee further intends to do all things lawfully within its power to obtain and maintain funds sufficient and available to discharge its obligation to make Rental Payments due hereunder and to exhaust all available reviews and appeals in the event any portion of the budget or appropriation request relating to Rental Payments is not approved. In accordance with applicable law, Lessee shall include the applicable Rental Payments in each budget or appropriation request submission as necessary to pay Rental Payments as and when due. Notwithstanding the foregoing, the decision whether or not to budget and appropriate funds or to extend the Lease Term for any Renewal Term is within the sole discretion of the governing body of Lessee.
Continuation of Lease Term. If Xxxxxx continues to occupy the premises after the expiration of the lease term, such occupancy shall not constitute a renewal of this agreement, but may, at the option of Lessor, constitute a month-to-month tenancy.
Continuation of Lease Term. You shall not enter into any Lease unless you, at the time, reasonably believe that, after taking into account the terms thereof, funds shall be obtainable through your governmental budgetary and appropriations processes in an amount sufficient to make all Lease payments during the Lease term. You hereby agree to direct your finance or budget officer to make provisions to the extent necessary for the Lease payments due under each Lease in each budget submitted for the purpose of obtaining funding. It is your current intent to make the Lease payments for the full Lease term if funds are legally available therefor and in that regard you represent that (a) each Lease is being entered into for the purpose of providing the Equipment to you, and the use of the Equipment is essential to your proper, efficient and economic functioning or to the services you provide to your citizens; (b) you have an immediate need for and expect to make immediate use of substantially all the Equipment, which need is not temporary or expected to diminish in the foreseeable future; and (c) the Equipment shall be used by you only for the purpose of performing one or more of your governmental or proprietary functions consistent with the permissible scope of your authority.
Continuation of Lease Term. Lessee currently intends, subject to the provisions of Section 8 and Section 12, to continue the Lease Term for each Lease through the Original Term and all of the Renewal Terms and to pay the Rental Payments under such Lease. Lessee reasonably believes that legally available funds in an amount sufficient to make all Rental Payments during the Original Lease Term and each of the Renewal Terms for each Lease can be obtained.
