Common use of Contracted Benefits Clause in Contracts

Contracted Benefits. Notwithstanding the provisions hereunder, no benefits shall be afforded to any employee when the Employer's contractual agreement with a third party for said benefits does not permit coverage of said employee. The Employer shall notify the Union as soon as practicable after learning of such exclusion. It is agreed that if benefits cannot be afforded to an employee because of the Employer's contractual agreement with a third party does not permit coverage of said employee, then, in such event, the Employer shall make a good faith effort to obtain comparable coverage elsewhere.
