Common use of Contracting In Clause in Contracts

Contracting In. (a) Nothing in this agreement prohibits the Employer from contracting with the Ministry of Transportation and Highways or any third party for the performance of work of any kind, which requires the use of employees, covered under this agreement. It is further recognized that such an increase in business will lead to improved job security for the Employer's employees, and help to xxxxxx an atmosphere of improved cooperation and strengthened economic relationship between the Employer and its employees. (b) For the purposes of this agreement, "project work" is defined as work, distinct from that road and bridge maintenance work contained within the contract(s) in effect between the Employer and the Ministry of Transportation and Highways. An existing third party contract or renewal thereof for the provision of road and bridge maintenance work activities consistent with those contained within the maintenance contract(s) with the Ministry of Transportation and Highways will not be considered project work for the purposes of this agreement. However, should the Employer secure additional third party work for the provision of road and bridge maintenance work consistent with those contained within the maintenance contract(s) with the Ministry of Transportation and Highways, the parties shall meet to establish the application of this. Should the parties be unable to reach mutual agreement, the matter shall be referred to arbitration pursuant to Clause 9.6. (c) Further provisions applicable to "Contracting In" (Project Work) are covered in MOU 6.
