When evaluating ability of tacit collusion among enterprises, it‘s needed to take care of some conditions which are useful to this collusion, including: (a) ability to define collusion conditions, (b) ability to break the breach of collusion and (c) punishment on breach of collusion. Additionally, it is needed to evaluate existing restriction of competitive capability and other conditions which restrain or prevent collusion among enterprises after economic concentration. In this process, it is necessary to analyze all evidence can be collected by competition agency, including if market conditions before economic concentration are advantageous or disadvantageous for enterprise cooperation and economic concentration impact on such market conditions. According to the Japan fair trade commission (JFTC), coordinated impact analysis is to recognize nature of economic concentration in which the parties of economic concentration can gain economic interests when cooperating and simultaneously increasing price without making competition restriction agreements, which violates Competition law. Principal conditions of analyzing coordinated impact of a horizontal economic concentration used by the JFTC are:  Market position of the parties of economic concentration and competitors before economic concentration – number of enterprises, similarity of relevant products and cost structure, competitive level , supply capacity redundancy.  Relevant market‗s features – transparence in business transaction, frequency and scale of contract, stability and saturation of demand, technology developing speed, competitive level before economic concentration.  Existing and potential competition pressure on marketimported products, entry barriers of new competitors, existence of product and geography market that can closely substitute for relevant market, competitiveness of other markets in vertical side with relevant researched market;  Economic efficiency and existing capability of the parties of economic concentration.

Each Vehicle will be of a similar specification to that outlined in Schedule 4 to the Team Entry Agreement. For the avoidance of doubt, the Company shall make no representations or warranties as to the suitability of the Approved Hirer or of the Vehicle for participation in the Event and any rights or warranties which a Team may have or be granted in relation to the Vehicle shall be limited to those contained in the Rental Agreement or implied by any Relevant Law.
