Cost of Proceedings. 8.1. The Tenant hereby undertakes, on payment of the instalments referred to in clause 6.2, to pay the collection fees for which the Landlord is liable in respect of the recovery of such instalment, if any. 8.2. In the event of the Landlord instituting legal proceedings against the Tenant for the recovery of the whole or any portion of the Debt, the Tenant shall, and hereby agrees to, pay for all legal costs incurred by the Landlord on the scale as between attorney and own client.

Cost of Proceedings. Except as provided in Article 8 and Appendix A for discipline cases, each party shall pay its own cost of arbitration procedures, including participants. The fee of the arbitrator, his or her travel expenses, the cost of any room or facilities, and the expenses of the arbitration, including filing fees, shall be borne by the party determined by the arbitrator to have been in the wrong, or the arbitrator may allocate the cost between the parties where neither party prevailed in whole. In the event of a pre-hearing settlement or an adjournment mutually agreed upon by the parties, any arbitrator's cancellation fee shall be borne equally by the parties. The expense of a stenographer or a transcript, if any, shall be borne by the party requesting it or equally among the parties requesting it, if more than one party requests.
Cost of Proceedings. The cost of the arbitration proceeding, including reasonable attorney's and experts' fees and expenses for both Parties, if there are any, shall be paid by the non-prevailing Party, unless otherwise determined by the arbitral tribunal.

If such Mortgaged Property has been abandoned or vacated by the Borrower and the Borrower has evidenced no intention of honoring his obligations under the related Mortgage Loan, the foreclosure process shall be expedited to the fullest extent permitted by law.

  • Termination of Proceedings In case the Trustee shall have proceeded to enforce any right under this Indenture by the appointment of a receiver, or otherwise, and such proceedings shall have been discontinued or abandoned for any reason, or shall have been determined adversely, then and in every such case the Issuer, the Company and the Trustee shall be restored to their former positions and rights hereunder, respectively, with respect to the Trust Estate, and all rights, remedies and powers of the Trustee shall continue as if no such proceedings had been taken.

  • Control of Proceedings The Party responsible for the Tax under this Agreement shall control audits and disputes related to such Taxes (including action taken to pay, compromise or settle such Taxes). The Seller and the Buyer shall jointly control, in good faith with each other, audits and disputes relating to Straddle Periods. Reasonable out-of-pocket expenses with respect to such contests shall be borne by the Seller and the Buyer in proportion to their responsibility for such Taxes as set forth in this Agreement.   • Other Proceedings No action, suit, investigation, bankruptcy or other proceeding (including, without limitation, the enactment or promulgation of a statute or rule) by or before any arbitrator or any Governmental Authority shall be threatened or pending and no preliminary or permanent injunction or order by a state or federal court shall have been entered (i) in connection with this Agreement or any transaction contemplated hereby or (ii) which, in any case, in the judgment of the Administrative Agent could reasonably be expected to result in a Material Adverse Change.
