Stormwater Improvements. The City engaged The Xxxxx Xxxxxxx Partners to complete a Build Greener Study, as may be amended (collectively “Building Greener Study”), to identify creative and potential ways to integrate stormwater quality measures into the Telegraph District, as may be amended. The Build Greener Study was based upon the Water Quality Best Management Practices per City Ordinance 28.03 and described as cisterns, flow-through planters, stormwater planters, permeable pavers, bio retention cells and turf bio retention cells, including, but not limited to, collection basins, pipes, drains, outlets, inlets, lighting, landscaping, electric lines, conduits, supports, foundations, improvements and related appurtenances (collectively “Stormwater Improvements”). The Stormwater Improvements locations within the public right of ways and alleys as generally shown on Attachment 4 of Exhibit E, as may be amended (“Stormwater Improvement Locations”).
Stormwater Improvements. Stormwater Improvements shall include installation of bioswales and downspout biofilters on the Project Site, which improvements were specifically approved by the City of Lincoln as an alternative to public storm sewer improvements due to the lack of storm sewer in the area. Redeveloper may seek reimbursement from TIF Bond Proceeds up to Forty-Two Thousand Dollars ($42,000.00) for Stormwater Improvements in the Project Area.
Stormwater Improvements. The City shall, at its sole cost and expense, design and construct certain stormwater improvements in the Western Park Site (“Western Park Site Improvements”) and in the Eastern Park Site (“Eastern Park Site Improvements”) (collectively, “Stormwater Improvements”). The Stormwater Improvements shall be based upon, and shall in all respects fully comply with, the Plans and Specifications, a copy of which is attached hereto and incorporated herein by reference as Exhibit A. The Parties specifically acknowledge that the plans and specifications attached hereto as Exhibit A at the time of execution of this Agreement may be preliminary in nature. Accordingly, the Parties agree that the Plans and Specifications, once completed, shall be attached to this Agreement as Exhibit A and shall replace any preliminary plans and specifications attached hereto at the time of execution. The Parties, through their respective Executive Director and City Manager, shall execute an appropriate document confirming the attachment of the Plans and Specifications to this Agreement as being the final Plans and Specifications for purposes of this Agreement.
Stormwater Improvements. NAH shall meet all City of Flagstaff stormwater, pre versus post retention, peak flow mitigation, Low Impact Development, and rainwater harvesting requirements per the approved drainage impact analysis, drainage report, and Specific Plan. The Parties agree that except as described in approved preliminary drainage report, no off-site infrastructure improvements are required other than to serve the Project.
Stormwater Improvements. The City shall, at its sole cost and expense, design and construct certain mutually agreed upon stormwater improvements in the York Commons Park Stormwater Detention Site, which improvements shall specifically include the installation of an automated shutoff valve to the inlet to said improvement to prevent said improvement from exceeding the 100 year elevation. (“Stormwater Improvements”). The Stormwater Improvements shall be based upon, and shall in all respects fully comply with, the Approved Plans and Specifications (as that term is defined in Paragraph 5.C. below), a copy of which is attached hereto and incorporated herein by reference as Exhibit A. The Parties specifically acknowledge that the plans and specifications attached hereto as Exhibit A at the time of execution of this Agreement may be preliminary in nature and may not be the Approved Plans and Specifications defined in Paragraph 5.C. below. Accordingly, the Parties agree that the Approved Plans and Specifications, once completed and agreed upon by both Parties, shall be attached to this Agreement as Exhibit A and shall replace any preliminary plans and specifications attached hereto at the time of execution. The Parties, through their respective Executive Director and City Manager, shall execute an appropriate document confirming the attachment of the Approved Plans and Specifications to this Agreement.
Stormwater Improvements. Owner acknowledges that a Drainage Impact Analysis, previously reviewed and approved by City, identifies several stormwater improvements that are necessary to accommodate development of the Project. Owner further acknowledges that the Drainage Impact Analysis contemplates complete construction of the identified stormwater improvements at the time of commencement of construction of the Project. In order to accommodate a phased approach to development of the Project, Owner agrees, prior to or concurrent with the construction of any improvements on any parcel in any Unit of the Project, to construct the proportionate share of those permanent stormwater improvements, including all necessary landscaping and appurtenances, identified in the approved Drainage Impact Analysis, to ensure that each Unit of the Project is independent of the other with regard to Low Impact Development and drainage. City’s Stormwater Manager shall reasonably approve the determination of the proportionate share. Prior to installation of landscaping by Owner, a Landscape Plan for those improvements identified by the Stormwater Manager within the Project shall be reviewed and approved by City in accordance with established City standards. This required landscaping does not include any soil stabilization required as part of the review, approval, and acceptance of a grading permit.
Stormwater Improvements. The Annexor shall design, construct and continuously maintain all stormwater improvements required by the development of the Property in accordance with the Code. The stormwater improvements may include, but shall not be limited to all pipes, inlets and detention areas on site as shown on the Final Plat for the Property.
Stormwater Improvements. If required, the CONSULTANT will design stormwater improvements in accordance with the design criteria specified in the Stormwater Management Manual for Eastern Washington and the applicable OWNER requirements.
Stormwater Improvements. The Parties hereby acknowledge and agree to the following:
a. Developer shall design and construct on-site retention ponds (collectively, the "Retention Ponds") and drainage basins to run adjacent to the Xxxxxx Road Extension (collectively, the "Drainage Basins"). The Retention Ponds and Drainage Basins shall collectively be referred to herein as the "Stormwater Improvements", which shall be used in part to accommodate the stormwater drainage from Xxxxxx Road. The construction of the Stormwater Improvements shall conform in all material respects to the Plans and Specifications to be submitted to the County and thereafter made a material part of this Agreement.
b. Developer shall design and construct, concurrent with Developer's construction of the Xxxxxx Road Extension, a stormwater connection system to facilitate the drainage of stormwater from the Drainage Basins to the Retention Ponds (the "Connection System"). The Connection System shall include a water treatment mechanism, to be located at the latest terminus before the stormwater enters the Retention Ponds, sufficient to remove debris from the stormwater before entry into the Retention Ponds. Upon Developer's submission of the final Plans and Specifications, the Parties shall use good faith efforts to coordinate the final design of the Connection System such that the Connection System is acceptable to both Parties.
Stormwater Improvements. The development on the Subject Property shall be constructed by Developer in compliance with all applicable Village and County stormwater restrictions and requirements in accordance the requirements of the Village Engineer and with final engineering plans to be approved by the Village.
