Covenant of Quiet Possession. Lessor agrees that so long as no Event of Default has occurred and is continuing, Lessee shall be entitled to quietly possess the Property subject to and in accordance with the terms and conditions of this Master Lease Agreement.
Covenant of Quiet Possession. Lessor agrees that so long as no Event of Default has occurred and is continuing, Lessee shall be entitled to quietly possess the Equipment subject to and in accordance with the terms and conditions of this Agreement.
Covenant of Quiet Possession. CALTRANS further hereby covenants that, subject to the terms of this LEASE, LESSEE will have exclusive peaceful and quiet enjoyment of the PROPERTY for the PRIVATE RAIL LINE during the TERM, without interruption or interference by CALTRANS or any person claiming rights by, through, or under CALTRANS. LESSEE acknowledges and agrees that LESSEE's exclusive right to possession of the PROPERTY during the TERM of this LEASE will be subject to: (i) CALTRANS’ rights of entry or access rights expressly provided for in this LEASE; (ii) the rights of third parties under any permits for existing UTILITIES as of the EFFECTIVE DATE, any permits that must be granted as a matter of law, and under any permits for UTILITIES issued after the EFFECTIVE DATE, so long as the subsequently issued permits are compatible with the rights of LESSEE and do not interfere with LESSEE’s construction, operation, and maintenance of a PRIVATE RAIL LINE, subject to the terms of this LEASE; provided however, that, upon request by LESSEE, CALTRANS will provide UTILITY contact information and make its right- of-way utility staff available (on a reimbursable basis) for meetings with third-party UTILITY owners to facilitate LESSEE’S property access and construction activities; and (iii) any rights expressly reserved by CALTRANS’ grantors in documents recorded in the Public Records of San Bernardino County, California, or expressly reflected or indicated on CALTRANS’ right-of-way maps, as of the EFFECTIVE DATE.
Covenant of Quiet Possession. The Lessee, upon the payment of the rent herein reserved and upon the performance of all the terms of this Lease, shall at all times during the lease term and during any extension or renewal term peaceably and quietly enjoy the leased property without any disturbance from the Lessor or from any other person claiming through the Lessor.
Covenant of Quiet Possession. Lessor covenants that at all times during the Term of this Lease so long as Lessee is not in default hereunder, Lessee's quiet enjoyment of the Leased Premises shall not be disturbed.
Covenant of Quiet Possession. Upon Tenant paying the rent reserved hereunder and observing and performing all of the covenants, conditions and provisions on Tenant's part to be observed and performed hereunder, Tenant shall have quiet possession of the Premises for the entire term hereof, subject to all the provisions of this Lease.

So long as TENANT pays all of the rent and charges due herein, TENANT shall peaceably and quietly have, hold, and enjoy the Demised Premises throughout the term of this Lease without interference or hindrance by LANDLORD or any person claiming by, through, or under LANDLORD.

Lessor shall, on the commencement date of the term of this lease as hereinabove set forth, place Lessee in quiet possession of the Leased Premises and shall secure him in the quiet possession thereof against all persons lawfully claiming the same during the entire lease term and each extension thereof.

Lessor hereby covenants and agrees that he is the owner of the leased premises in fee simple and that Lessee, its successors and assigns, upon payment of the rent herein reserved and the performance and keeping of all of the other terms, covenants and conditions hereof to be performed and kept by the Lessee, shall and may peaceably and quietly hold and enjoy the leased premises during the term hereof or any extension thereof.
Covenant of Quiet Possession. The County does not make any representation or covenant that the Company shall have quiet and peaceable possession of the Project; provided, however, the County agrees that it will not take or cause another party to take any action to interfere with the Company’s peaceful and quiet enjoyment of the Project. In the event peaceful and quiet enjoyment of the Project shall be denied to the Company or contested by anyone, the County shall, upon request of the Company, join where necessary in any proceeding to protect and defend the quiet enjoyment of the Company, provided that the Company shall pay the cost of any such proceeding and shall reimburse and indemnify and hold harmless the County from any cost or liability resulting therefrom.
